attorney joyce vance. who spent 25 years as a federal prosecutor. joyce, let me start with you because a former federal prosecutor said to me tonight, ignore the u.s. attorney's manual. there are two things that they had to have suspected michael cohen of doing to have obtained this search warrant. one, either he was non-responsive to subpoenas, or, two, they have evidence or suspicion that he was destroying evidence. your thoughts? >> i think it's unlikely that he was just non-responsive to subpoenas. i think that they would have continued to try to work that out. that leaves me with the choice behind door "b," the fact that they believe there was evidence that was at risk of destruction. and also that they believe that they were entitled to pierce this veil that really covers lawyer-client conversations and communications in secrecy, and there was probable cause to believe that there was evidence of criminality that superseded that privilege so that it was appropriate for them to go in and collect evidence. >> so we listened to that sound together

joyce, let me start with you. the judge's ruling today, what's your takeaway from that? >> it's the correct ruling. in a criminal case, there are a variety of mechanisms for a defendant to judge the validity of the lawsuit. he can file a motion to dismiss. he can challenge jurisdiction. what manafort did was to go outside the confines of the criminal case and to file a separate civil lawsuit. he tried to challenge mueller's legitimacy, really, as a special counsel in that lawsuit. and the judge properly dismissed that. >> renato, right now it seems like the path is cleared for a trial some time in the fall. what would that trial look like? >> well, it would be a -- excuse me. it would be a lengthy trial. there would be many, many witnesses. a lot of documents and records. there are many cases that -- excuse me, there are many charges against manafort, complex charges like money laundering, for example. charges related to his various disclosures of bank records. so you would literally have witnesses coming in from various entities, talking about how their records are kept

i want to get to you, joyce. the process by which robert mueller has to submit a report to rod rosenstein and then it's rosenstein's decision how that comes out, to make it public, writes a report of his own, or submits it to congress and congress has to decide what to do with it. walk me through how that usually happens. >> i think it's hard to talk about how it usually happens because it's such an unusual and rare kind of a situation. but one thing that we know about rod rosenstein, he certainly has his did etractors, but he belie in the justice department as an institution. he's a firm believer in the rule of law. so on there's a quirk here which is that much of what the evidence mueller is gathering is coming in through the grand jury. and that material they likely won't be able to release, so perhaps there will be some sort of an edited version or perhaps a summary version oth evidence. and of course congress could alys, if it chooses to, subpoena the full report and all the evidence from the special counsel
