kpix 5's len ramirez is in san jose with reaction from the city. >> reporter: well the san jose housing department says it agrees with the court's decision that criminalizing homelessness and poverty is not a solution, but that perspective may be put to the test as more and more people appear to be moving into the parks and sidewalks of san jose. tents and piles of homeless people supplies are now sprinkled around st. james park as homeless people appear to be moving in to stay. at the same time the san jose police have stepped up patrols and appear to be questioning people sitting on benches. the city has been trying to clear out the park for years, but under a supreme court decision, there might not be much the city can do if homeless people decide to stay. >> it's a small victory. >> reporter: pastor scott wages ministers to the homeless in san jose and say it is court made the right decision to let stand a lower court ruling that allows homeless to stay in parks or sidewalks if there's no other shelter to stay. >> i think not allowing them to stay anywhere, literally having nowhere
