now kim potter goes into custody. the judge refused to let her go out on remand by the fact that she is catholic, it's christmas time, the defense made the argut that she's never been in trouble before, and she has been sentenced yet, and the judge said she cannot treat this case differently than any other, and it is standard practice to send someone into custody. >> mike: jacqui, we saw protesters gathered outside the courthouse seeming to celebrate the conviction of this police officer. let's check back in with garrett denny what is the scene they are? >> you can hear behind us here in the back of the courthouse this crowd chanting "daunte wright." when that verdict was read in court and the crowd got word of it, it erupted into cheers, similar to what we saw when the verdict was announced in the trial of derek chauvin. a lot of happy folks here today, because the justice they say they have been calling for -- what was interesting, kim potter, is that verdict was read in court, very stoic, very little emotion. a sta

griff: a minneapolis jury hands-down a verdict for ex-cop kim potter on two charges for the death of 20-year-old daunte wright in april. trial attorney and former prosecutor, merry christmas to you, thank you for taking time to join us early as we get ready for the holidays, very difficult trial watching all of that yesterday. what is your reaction to the verdict? >> my first reaction is this was a deliberation. there was a long deliberation. legal experts like myself were questioning whether or not we were going to get a verdict. went on for four days. 27 hours of deliberation on two counts and it wasn't an entirely complex case. it was a split-second decision by kim potter and the jury took its time, it was a deliberate deliberation and certainly it is tough to look back and criticize it. they were the ones in the court room, the give the evidence and came out with a tough decision, they were unanimous as they did it. griff: carrying up to 15 years, we will find out what the sentence is. let me ask if you were representing potter would you put her on the stand, what were your thoug

i've got no love from kim potter and what she did here. that was especially true after her testimony. but from the beginning, reviewing this evidence, i don't see anything they can rely on to prove that she behaved consciously, because they have acknowledged that she made a mistake in wrongfully drawing her taser instead of her gun. >> so, shaq, let me -- i know that you obviously have been covering this throughout, you've been in touch with lawyers. what should we expect to hear today? and on both sides, what do we see as the heart of their case. >> i think you're hearing that from the prosecution right now, as they try to lay it out in saying that this is a 26-year veteran of the police force. she should have known the fundamental difference, they say, between a gun and a taser. you heard the judge, right before these closing arguments begin, she went through those jury instructions. nearly a dozen pages, instructing the jurors on what the law is and how to apply the law in this case. and one point that you can bet the prosecution will h

kim potter now faces up to 15 years in prison. the judge ordered her held in custody, without bail, until sensitively, in mid february. henderson, -- and he joins me, now. david, i think a lot of people were somewhat surprised by this outcome. not necessarily -- and the facts, as stated, and the leniency, or charitable interpretation, that juries tend to give police officers. what's your read on the outcome? >> chris, i think calling the surprising is an understatement. you have to remember, this is the same city that refused to convict a police officer who wrongfully killed philando castillo. when you put it in that context, in my lifetime, this goes all the way to the rodney king case. the police resolve ways take in the case of, it's a dirty job, if we make mistakes, we're just going to have to look the other way. for the most part, that has succeeded. this verdict says, this is not the case any longer. not only are we going to hold you accountable if you do something wrong on the job, but also if you make a mistake, though it

the jury in the kim potter trial heard closing arguments this morning in minneapolis. potter is charged with multiple counts of manslaughter after she shot and killed daunte wright, a 20-year-old black man, at a traffic stop last april. the jury will have to consider if she was responsible for wright's death and if she acted recklessly with her firearm when she drew her gun instead of her taser. the paul henderson is the executive director of san francisco's department of police accountability. also joining us with nbc correspondent shaquille brewster. shaq, how did both sides sum up their arguments in the trial? >> you heard two different depictions, which was not unexpected. this was a 27-year veteran of the police force. the prosecution said she was acting with negligence when she pulled her firearm instead of her taser. meanwhile the defense said this was about daunte wright and his actions. had he not attempted to flee, he would still be alive and he created the situation of chaos that led to a mistake occurring. one key part that you heard, one key distinction fr

a remorseful kim potter. what does the law say here, particularly the law when it comes to first and second degree maugt manslaughter, the charges she is facing here? >> it looks at the conduct and the reasonableness or unreasonableness of the conduct. the first-degree manslaughter requires jurors to find her conduct was reckless. the second-degree manslaughter charge only requires a finding of criminal jusnegligence. there's been a lot of focus on the emotional testimony of kim potter. we know she was e moepgs nal right after she shot daunte wright, saying, look, i'm going to jail. it's hard to know whether, you know, those tears or the emotion we saw on the stand was about being sorry about killing daunte wright or being scared about going to jail. i think we're not focusing enough on she pitched milted on the witness stand during cross that her conduct was unreasonable, and that makes the prosecution's case. the question is will the jurors overlook that because of her emotional testimony. >> that's an impo

kim potter will be sentenced in february. what kind -- >> it depends on whether they concurrent the sentencing rather than consecutive. the judge may stick to the sentencing guidelines. if so, she's looking at a number of years in jail. for a crime like this, you may see, if the sentences are run concurrently, somewhere on the order of 5, 10, 15 years. >> prosecutors have said they would like to see a sentence that goes above the guideline range there in minnesota. what room does the judge have to do that in a case like this? >> in minnesota, as in many other jurisdictions, there are aggravating circumstances, such as the crime is committed in front of a child, different thing to aggravate and boost a sentence. the prosecution is going for gold, trying to get the biggest sentence they can, which is understandable. that's what prosecutors do. so, as long as they can prove those elements in minnesota, to boost the sentence, they can ask the judge for an increased sentence. >> you've been watching these cases against police offi

andrea. >> thanks so much, shaq, and joyce vance, so you watched kim potter on friday. very emotional. do you think that helps or hurts her? it's mostly white jury. or is it just too hard to predict how a jury will react to that? >> well, the defense strategy in a case like this, andrea, is to appeal to at least one juror. if they can convince one juror this was a tragic mistake, not some form of carelessness, then that one person who refuses to vote to convict could hang the jury causing a mistrial, and although there could be a second trial, prosecutors never like to try their cases a second time. the evidence never comes in quite as good as it does the first time. of course the goal for the defense is to win an outright acquittal here, but the difference between a murder charge and a manslaughter charge is that murder requires proof of intent, and that's not at issue here. both sides can see that potter did not act intentionally. instead, what it comes down to is whether the defense can convince the jury that it was a mistake, that she didn't fail to exercise care, t
