georgia republicans and really republicans throughout the country, but i think particularly in georgia are obsessed with the idea of an outsider. david perdue is now a candidate for governor and he ran for senate in 2014, outside label front and center, outsider politician and you know, there's no outsider quite like hershel walker. he hasn't lived in the state for years. he lived in texas and just moved back to run for office. and he wasn't involved in conventional politics, he was a big trump surrogate, but wasn't involved in day-to-day politics in georgia. so he's running as an outsider and also with the trump brand. it might not matter he might have been in this position even without trump's endorsement, but he's looked at as part of the pro-trump slate and part of the former president's image, attempt to remake the republican party of georgia in his own mind. in his own image. he wants to oust a lot of the incumbents who aligned with governor kemp or he feels aligned against him in the 2020 election even though there's lockstep with support here. but a lot of election is hinging o

today, state prosecutors in georgia notified mr. giuliani that they no longer consider him to be a material witness in their criminal investigation election interference in the state of georgia. mr. giuliani's lawyers say they were notified today by georgia state prosecutors that their client, rudy giuliani is now officially a target of that investigation. prosecutors are warning giuliani that he may get indicted in that case under georgia state law so he should get his ducks in a row. beyond that, trump ally lindsey graham, he had argued recently in federal court he should be allowed to defy a subpoena to testify to the grand jury in that case. senator graham said he notified that he's not a target. he's just a witness but he does not want to answer a subpoena to testify in that case because he told a court in georgia he's just doing his job as a senator and he should be protected as such from it having to answer questions about him. his lawyers argued to the dhurt when senator graham called georgia officials after the presidential

so senator lindsey graham still fighting to stay out of court and testify in georgia. are you convinced that he will testify as scheduled on tuesday? >> i believe he should testify. what the fight is about is the speech and debate clause of the constitution which provides that if your activities during your legislative work are something that the judiciary wants to hear about, you can be prevented from having to be called there. he's saying that these phone calls that he made to georgia and other calls that he may have made to other people is part of his legislative work. the court said, no, it's not. this is separate from legislation and, therefore, you have to appear. and so that's the fight. the judge has looked at the speech and debate clause. we saw this, fred, in the case of menendez in new jersey where he tried to do the same thing when he was charged with bribery in connection with his lobbying activities. the court said no, no, no, that's not legislative activity, that's something separate. so we'll see what the court of appeals says. but he should lose this c
