it is once again open in san jose. a stretch was closed for much of the morning after a car struck a chp officer on the side of the road there. kiet do joins us now from bascomb avenue interchange where from what we have seen, there's still a little hail on the road that. might have been part of the problem. >> reporter: you can see some of the hail. it's probably half inch to an inch thick in some spots. but this was really a big problem at about 2:00 this morning. we have some videotape of a chp officer arriving at valley medical center here at san jose. he had a broken leg and possibly facial injuries. they were non-life-threatening. this all began sometime around 1:0 or so. that's when chp got -- 1:30 or so when chp got reports of ice on the road in both directions on 880 at bascomb. somebody was having problems with a tire. the chp responded. he was outside of his vehicle and was hit by an oncoming pickup truck. he was knocked into the shoulder and that -- where ended up in the hospital there. but they shut down t

according to the "san jose mercury news" the d.a.'s office says this argument is flawed saying there is no legal precedent for that rationale. medical marijuana is still illegal under federal law but when california voters legalized it more than 100 pot clubs popped up all over san jose resulting in a cloudy haze of confusion. recently the city council limited the number of clubs to 10. the d.a.'s office plans to work with business owners to get them to comply through written warnings rather than raids. there will be raids in the future but they will try to be i guess nice about it. they plan on releasing these proposals in the coming weeks and then opening up for public debate. >> thank you, kiet do in san jose. >>> the city of san carlos has decided to form a hybrid fire department with redwood city to save money. late last night the city council voted unanimously for the redwood city plan choosing it over a proposal to hire a private company based in florida to run it. a firefighter from neighboring san mateo says the hybrid option

bob redell is live in san jose with the latest for us. good morning, bob. >> reporter: good morning to you, marla. from his office in the civic center in downtown san jose, jeff rosen has been drawing up guidelines, clarifications, rules on how marijuana collectives can operate here in the south bay. the idea behind the effort is to cut down on the number of police raids on pot clubs in san jose. police raided several without warning. they said under new guidelines proposed by rosen, in the future, the clubs would be given a warning, opportunity to right whatever their violations are instead of officers banging down the doors. the principle is to treat them as legitimate nonprofits instead of illegal businesses out to make a profit. he's not offering a get out of jail free card, he wants them to follow state marijuana laws and trying to reduce the tension and friction present between the collectives and law enforcement. he's expected to release the rules in a few weeks so you, the public, can comment. there are more than 100 clubs in san
