amy hollyfield is live at the police department. amy? >> reporter: it will be a somber morning at the police department. they're due here at 8:00 a.m. to turn in their badges. the city has a $15 million budget deficit to deal with. the city couldn't reach an agreement with the police union on pension reform. so layoffs are the result. this comes as the homicide rate is on the rise here in san jose. there have been 28 homicides this year. that is more than they had all of last year. also, this is happening right before a busy holiday weekend. >> we have stepped up, we have overtime positions that are available. so that we can respond to events over this one weekend as a holiday weekend. that doesn't touch the weekend after that, which is still going to be a hot summer night. >> mayor chuck reed released a statement saying, "we have some of the finest police officers in the country. and i'm sorry that we have to let some go. i think we need more officers on the streets, not less. we just can't afford them." some of the laid off officers ha

amy hollyfield is more on that. amy? >> reporter: yeah, eric, check out the sign that says they are still at a moderate fire danger level. kind of surprising. i checked in with the fire station in oakland hills the fire officer here said well, we wait to hear from dispatch before we change it. there are some prep underway for fire season. goats are hard at work in the hills above oakland parkwood copped minimum. they're clear -- condominium. they're clearing out the brush. most homeowners are getting a late start for preparing this year. since we had late rains, people haven't started the brush clearing yet. they are not planning the inspections until tuesday. today's hot weather will be a good reminderi.'s time to get ready. >> fire season was uneventful which works in our favor. at the same time, people might let their guard down with the heavy rain and increase in vegetation. people have to be on their toes. >> oakland hills is one of the most vulnerable spots in the bay area. 1991, a fire burned 3700 homes. residents

let's go down to san jose and amy hollyfield. >> reporter: good morning. here in san jose they are facing big layoffs because contract talks at city hall broke down last night. they are now looking at 278 layoffs at the police department and this is terrible timing. murders or the rise. they have had 22 this year in san jose compared to 20 in all of last year. city has a budget deficit to address. city is hoping a recent reaching a deal with the officers. but the deal would have meant layoffs, 122 layoffs but now they are looking at 278 layoffs. both sides expressed disappointment they couldn't reach a deal. yesterday was the deadline to make it into the city's budget. they'll have to have it in place by the end of the month. there is still a little bit of hope that city officials could order everyone back to the table to try again but right now, no deals, 278 layoffs coming to the police department. amy hollyfield, "abc 7 news." >>> checking other top stories this morning. >> national weather service is sending out a team to determine a strength of a torn

abc7's amy hollyfield is live outside the hospital. amy? >> firefighters are here pulling for their colleague. they are upstairs on a floor reserved for staff. the guard tells me some of them have been here all not long. they are here for 53-year-old anthony valerio who is in critical condition. he is suffering from severe burns. doctors are worried about his lungs. all of the hot air he inhailed. he was with 48-year-old vincent perez who was pronounced dead at the hospital. colleagues say perez dreamed of being a firefighters and loved his job. >> he had a good sense of humor. as a firefighter, he was always the first guy in the fire and the last guy out. he was a real firefighter's firefighter. >> his whole adult life was serving the community and protecting the community. >> firefighters say it will be tough without perez, that he always was keeping everyone in the fire station in a good mood. a third firefighter was also hurt yesterday. she was able to walk out of the fire and treated and released from the hospital. her name has not bee

amy hollyfield has more. >> reporter: it looks ready. they cleaned up the 200 gallons of diesel fuel that spilled out here. all the debris from the accident is gone. the street-sweeper isn't even out here anymore. you may see the cars pass through here while we're on the air. it should be opening any minute. but they did have quite a mess to clean up. a three-vehicle accident that happened around midnight. look at the cars involved. it's a surprise there were no major injuries. four people suffered minor injuries but they're all expected to be fine. this happened on northbound 880 around 7th street in oakland. reckless driver was speeding through here. he rear-ended a car. shoving it in a big rig. the big rig then ran into the guardrail, which ripped open the fuel tank. >> the big rig hilt, went off on the shoulder. hit the guardrail there. went across the lanes of the freeway and hit the guardrail on other side rupturing the other fuel tank. >> that's why they had 200 gallons of diesel fuel to clean up. that is what took so long. then t

abc7's amy hollyfield is live in walnut creek with the latest information. amy? >> reporter: two police cars arrived at the apartment building, next to the scene of the crime. it appears they are working the case, though they made two arrests. the two men they arrested they said did confess. two victims were taken to the hospital last night with stab wounds. a third victim was located later. he had a cut on his arm and he refused medical treatment. police searched last night and this morning announced they made the arrest of two men. this happened at 8:45. a fight broke out between five men at the parking lot of the walnut creek car wash at north main street near geary. residents of the apartment complex next door say they heard yelling and arguing. this is a very busy area. the apartment building, lots of businesses, restaurants and coffee shops. no one can believe this happened here. >> i was asleep until i saw the commotion. >> what was your reaction? >> scary. >> i've lived here a couple of years and that is the first time. >> this is bad news for the area. i

abc7's amy hollyfield is live at ocean beach with the story. amy? >> kristen, the fishermen are okay. check out what is left of their boat. mostly submerged, you can just see the tail end of it here at ocean beach. the coast guard is now trying to figure out how to get to it. and recover what they can off of it. it's not as easy as you might think. the fishermen are from arcada. they think the boat had a shift -- a load that shifted about 12:40 this morning and that's why it capsized. it had 270 crab pots on board. 80 of them were full. so they think that the load shifted. that is why it threw everything offbalance. why they ended up in the water. they were well prepared. when the coast guard found them, they were all okay. >> they had survival suits and they had a life raft. not sure if it automatically deployed or they deployed it themselves but they are lucky they had it. >> the fishermen said it happened very fast. they're now resting and waiting for the wife of one of the men to come and get them. i want to show you a live picture again of the

amy hollyfield, abc7 news. >> thank you. . california has a new budget deal one the governor and democratic lawmakers can both agree on. republicans don't like it though it calls for deep spending cuts like they've been calling for all this time. terry mcsweeney will explain. >> reporter: it relies on billions of additional revenue. two weeks ago, the governor vetoed a democratic plan because it relied on accounting gimmicks. this new one assumes that the state will bring in extra $4 billion in revenues. revenues have been running higher than expected in recent months but if it's wrong, k-12 schools could see billion dollars in cut and school transportation could see $250 million in cuts. health and human services and state universities could lose $200 million each. >> they get to decide what is cut and decide which programs do or don't exist. their decision. if schools close for a week it's their decisions rather than making cuts in other places that would make more sense. >> budget highlights, redevelopment agencies are elim

amy hollyfield joins us from the newsroom. how much is this tax going to generate. >> it's it will generate $200 million which will definitely help. and does the benefit outweigh the negative impact? amazon and overstock has found away around it. the products that are located in california they can sever ties with them. this is what they've done that have passed an online sales tax. some mom and pop stores have been hitter by this. when amazon stops doing business with you, that can impact the bottom line and put stores out of business. so critics say this is a terrible idea. most small businesses support the idea of an online sales tax. they believe it will level the playing field. the proposed budget does eliminate the 9.6 deficit and it still needs approval from jerry brown and he has not said what he thinks of it >>> johannes mehserle's attorney says the former bart cop is spending time with his family. he was released from jail on monday after serving a year for the shooting death of oscar grant on new year's day in 2009.

abc7's amy hollyfield is live at the scene near 7th street. amy? >> reporter: i have good news for commuters. bad news for us reporters. they want all of to us get off of this highway. as soon as i finish the report, we have to get off the highway. they still want to clean our leap that we're taking up -- clean our lane that we're taking up. but the good news for commuters this is the last lane they have to clean and then they can reopen the highway. they're make progress gress and will probably get it open before the original expectation of 7:00. they had quite an accident to clean up. look at the vehicles involved. it's surprising no one was seriously hurt. four people suffered minor injuries from aches and pains to a broken ankle. one reckless drive around midnight caused all of this. he was speeding. he rear-ended a car. that car hit a big rig, which slammed in to two guardrails and ruptured both of the fuel tanks. 200 gallons of diesel fuel spilled on the highway. cleaning it up is what is taking so long. >> they will dust the diesel with abso

abc7's amy hollyfield joins us outside federal court in san francisco. amy? >> reporter: cheryl, barry bonds did not comment today but he and his legal team appear anxious to get this over with and be able to move on. that is not going to happen. barry bonds arrived almost an hour before the court hearing started but it lasted only six minutes. the judge came out and said if the prosecutors want more time, they should have it. the defense wanted the prosecution to announce today whether they want to retry bonds on the three perjury counts. the jury in april deadlocked over. i thought for a long time and maybe you thought the government has had months to decide whether they intend to retry the counts as to which there was a hung jury. they said in court today if i heard it correctly, they haven't decided. >> bonds was convicted of obstruction of justice and he has asked that conviction be tossed out. prosecutors told the judge it's not sense to believe set retrial date on count tas caused the mistrial until they know whether the convicted counts will be thrown
