did the prosecutor make cindy a little more sympathetic? >> well, by going after her that way, i think that they may. i think there would have been a more subtle way or more gentle way to go after her. but, look. here's the deal. when you are prosecuting a murder one case, and you have a witness take the stand that you believe is lying, you got to do what you got to do. it's basically take no enemies. >> i don't think -- no, no, when you got the mother of -- when you got the grandmother of the victim who's clearly a sympathetic figure, there is a way to ask these questions that you don't have to seem like you're going after her. you can say it in exactly the same way. you can challenge her on exactly the same points. but the tone was so aggressive. >> you mean more puzzled. >> exactly. exactly and the prosecutor was so aggressive with cindy anthony that think there is the real risk of engendering a level of sympathy with her, even if the jurors don't necessarily believe everything she is saying. even if her memory has gotten better. >> that

and there was no inquiry about that with cindy anthony. it's really a preposterous part of the defense. again, we understand cindy. we understand the loss of her family. we understand the motive for not being forthright about that. but it just is not working. it has not worked at all. >> what's interesting is that then the prosecutor spent a little bit of time with cindy trying to establish, here are the dates you may have been at work. might the prosecution be trying to figure out, if she was at home, they have some time stamps of when the searches took place of the chloroform versus chlorophyll. if she was at work at that time, it couldn't have been her even though she said, the computer could have been on and i'm not sure what the computer's doing when i'm at work. >> listen, fred, the bottom line here is, yeah, there may have been a punch-in at the office when she went there. she testified the records are gone. nobody can verify her work records, whether she was there or not then. but this was devastating evidence to the prosecution. i

mark lipman is the attorney for george and cindy anthony. he told gary tuchman they will do all they can to keep their dautder from getting death penalty even though they do not believe she is innocent. here is how gary describes his conversation with the anthony family lawyer. >> reporter: today i talked to their family attorney, mark lipman. mark hasn't wanted to talk about that but i explained to him we don't want to sensationalize this. george could be in a lot of trouble if the jury ultimately believes what the defense is saying, that the child accidentally drowned and george had something to do with the disposing of the child's body. mark lipman told me this. i asked him a specific question. i said, do your clients, george and cindy anthony, think that she is not guilty. his answer was they do not think that. he said they want to see justice done and see the truth come out. then he added to me, he said, they do not believe she's innocent. that being said, okay, this is very important, he wanted me to stress this, they love her and supp
