a ktvu news crew is on the way to the scene. here is what happened, the fight happened at about 915 tonight at the walnut creek car wash on north main street near geary road. the two people are said to be in critical condition. we'll have more coming up shortly on a live report. >>> and new information tonight about the driving history of the man behind the wheel of the big rig that slammed into an amtrak train sparking a deadly fire. according to the nevada department of motor vehicles, the truck driver, 43-year-old lawrence valli, had six moving violations since 2008, including four speeding tickets. friday's collision, east of reno, killed valli and five people on the train. witnesses say the truck ran through the crossing gate and hit the train broadside. skid marks indicate that valli tried to stop. investigators say they found a cell phone at the scene of the crash that likely belonged to valli. it is now being looked at to see if he was talking architecting at the time. one of the prior citations was for driving with a ce

this is ktvu channel 2 news at 6:00. >>> good evening everyone. i'm heather holmes. >> and i'm ken pitchet. authorities are calling it an accident. a car plows into a nursing home, killing one person. it happened around 9:45 this morning at the amberwood gardens home on peterson avenue. authorities say a 90-year-old woman visiting the nursing home hit the gas pedal instead of the brake, sending her car through a window and into the common room. at least 10 people were in that room. seven of taken to the hospital, fire officials told ktvu news that one of the victims died this afternoon. a volunteer at the nursing home told our cameras what he saw. >> i saw a car halfway between -- it was halfway in the wall and it just kept moving forward and hit quite a bit of residents. it was pretty scary. >> the driver was not injured in the crash. no word tonight on the identity of the person killed or the conditions of the other victims. residents at the home have been moved to a different area. >>> no official death toll but quote multiple passenger deaths.

ktvu's claudine wong joining us live from san jose. she tells us this is happening during a very violent year in the bay area's largest city. claudine. >> reporter: well, the budget crisis hits home this morning for the san jose police department as almost 70 officers are getting ready to turn in their badges this morning as part of the city's effort to close their budget gap. that process expected to get underway in just a couple of hours at the department. emotions are expected to be high. now the union tried through negotiations to save jobs with a new contract. they were able to save hundreds, but they weren't able to save these. and in a letter published in the san jose mercury news today the police union president is blaming city leadership saying they could have done more to keep these officers on the job saying the mayor and the majority of the council chose to "shut their eyes, cross their fingers and hope for the best." adding to the already tough times san jose's homicide rate which is at 28 this year on pace the union presi
