correspondent julie banderas shows us what happened. >> it has been a tense 17 hours since they were ordered to close zuccotti park. birthplace of the occupy wall street movement used as a campground by thousands of demonstrators for months now. it started and 1,000 people have been arrested. 200 last night. this guy tuesday afternoon after he ran in the park and tried to get the american flag confiscated by police. in the overnight raid greenlighted by michael bloomberg, the city officials warned demonstrators the park was cleared cleared and restored. but when officers moved in at 1:00 a.m., hundreds of protesters staying in the park overnight resisted. brookfield property is the owner of zuccotti park asked the city to help clear the park, which had been parked with unsanitary cons. mayor bloomberg said the park would be reopened. >> the first amendment protects speech. not the use of tent and sleeping bag to take over a public space. >> but protesters say the more resistance, the stronger they will stand. >> on the 17th, so manymore people come out because of this. it doesn't sto

julie banderas is live in zuccotti park in new york city. what is going on there this morning, julie? >> reporter: well i can tell you this, they have got a lot of ideas. it is night and day quite clearly as compared to what days ago when this place was filled with hundreds of demonstrators spending the night with camps set up and tents and sleeping bags but a far cry from what it looks like this morning. in fact overnight just about a dozen people decided to spend the night here instead of using their cushy sleeping bags, they had to sit up straight on these marble benches. there is no sleeping allowed. they can not lay down but can fall asleep standing up what i'm told or at least sitting up. this place has been home for nearly two months for many of these people. they spent the night talking, trying to stay awake, occasionally chanting we are the 99%. a reduced police presence here though as well with about 30 cops keeping watch. people are having their morning breakfast. they're allowed to bring in food as well as, you know, their belong

julie banderas is here in new york with the latest. julie, the police are not saying much about the raid. do you know whose house it was. >> reporter: apparently, you should property records, according to property records, it is owned by dale smith sr., dale smith jr. is the father of the three-year-old twin and it is last person to see michelle parker alive and also happened to be her ex-fiance. so they raided the home. 12 law enforcement officials knocked on the door saying they had a search warrant. and they went in and they led dale smith sr. out in handcuffs. we don't know why. we do know they didn't find michelle parker in the house. there were a couple of other adults inside at the time, as well as two children. they asked them to get out. they had them stand in front of the house on the front lawn while they searched the home. fbi showed up and they took several pieces of evidence out of the home. but we don't know exactly. they have been very tight lipped from the very beginning because of a gag order set by a judge. the law e

julie banderas is live on the scene. julie, what can you tell us what happened last night? >> reporter: i first want to mention the court order you talked about. we got word the court hear something at 11:30 this morning. lawyers on behalf of occupy wall street protesters are saying they will go into court and argue these protesters, demonstrators should be allowed back into zuccotti park with their sleeping bags and their tents. the mayor said while they have closed it for now they will reopen it after they clean the whole thing. but tents will be banned that is the court order you were just talking about. this has been going on for nearly two months. the mayor says he has been tolerant, this has become absolutely unliveable, unsanitary and unacceptable. dozens of people who refused to leave overnight were arrested. in fact up to 100 now, including several who actually chained themselves together to trees using bike locks. city officials warned the demonstrators the park was being cleared and restored and those who did not leave would be arrested. they began terri -- teari
