i caught up with republican senator mike lee from utah to talk to the supreme court decision this week to take up the legal fight over the president's healthcare law. thank you very much for making time for us today. one of the things, of course, just all over washington that we are waiting for is to find out what happens to the supercommittee if they can reach a deal before thanksgiving. you will be meeting with a tea party group that says they can save $9.7 trillion and do it without raising taxes. what are your hopes that something like that can be accomplished? >> i think we have to get to that point if we want to balance our budget. freedom works and other groups have given us proposals and advice on how to do that. >> shannon: do you have hope that the committee will get something done by the wednesday deadline? >> i have hopes that we will do it and hopes that we will find anything to allow us to make the cuts that we need to make. i have been a pessimist about the supercommittee. it is not a recipe for success when you try to consolidate into a 12 person committee and have them

and now live from pennsylvania is david lee miller. a couple of new developments today. tell us. >>reporter: well, we will start with mike mcqueary the centerpiece of the prosecution case, very crucial. he says that he saw the abuse taking place in the shower and he sent e-mails to a friend reported yesterday where he said that he had contacted the police in 2002. now it is reported by a local newspaper here that mcqueary told police in a statement did not mention in any way discussing the matter with the police in 2002. again, contradicting the e-mail that he tried to contact authorities. quickly, look at what the grand jury statement says about mcqueary and i quote, "the grand jury finds the assistant to be extremely credible," and it is his testimony that led to the criminal charges against the two in the administration at the school and arguably also contributed to the firing of the head coach, joe paterno, and the school president losing his job. but there are many more questions about mike mcqueary and inconsistencies that remain to be cleared up. >>shepard: you mentioned t
