ross mirkarimi returns to court today to try to win the right to see his son. amy hollyfield is live at the hall of justice with the latest. >> reporter: sheriff ross mirkarimi has said not being able to see his son has been crushing. today he's going to try and different tactic. he's going to ask the family court to allow him to see his 2-year-old son or at least have supervised visits. the criminal court judge issued a stay away order mirkarimi hasn't been allowed to see his family since he was charged january 13th. he asked the criminal court to lift the stay way or the judge said no. legal experts say mirkarimi might have a better chance in family court where the goal is to preserve the family and see a family reconcile its differences. >> ultimate question for the judge, the family law court judge is, really the best interests of the child. sometimes they do grant supervised visits. that -- if the child is being traumatized by being separated from one parent that is a way to minimize that damage. >> reporter: mirkarimi has pleaded not guilty to three misde

the big question is, ross mirkarimi and his wife eliana lopez. is she going to testify? and what is she going to say? >> she is not going to testify. she can't testify. the prosecution won't give her a grant of immunity. for that reason she is not going to testify. she is not going to testify because she can't unless they give her immunity she can't testify. >> why would she need immunity? >> because i'm not going to disclose -- well, many victims ask for immunity and most often the prosecution grants immunity. she needs to grant state court community, federal immunity. because she is not a citizen. >> so i guess what it is is if she supposedly -- if he testifies, correct me if i'm wrong, and says, okay, we got into a fight. and i was involved in it, as well. she doesn't want to be charged with domestic violence for saying that. >> exactly. >> okay. so it's a question of what she is going to say on the stand if she testifies. she wouldn't necessarily say that he hit me and i wasn't involved in it. >> i'm not going to say what she would say but i'm going to say this, that
