he, of course, grew up in louisville. but his interest begins to grow in the 1920s when harvard law school expands. and brandeis is very much opposed. brandeis has been a generous contributor to harvard law. he'd been one of the founders of the harvard law school alumni association. he was its longtime secretary. he was on the board of visitors. but in the 1920s feels that harvard is still a 19th century law school and in order to meet the needs of the 20th century, they'll have to expaged the faculty, and in order to expand the faculty, they're going to have to expand the student base, it would mean larger courses, at least in the general courses, first year contracts, and brandeis is dead set against it. so, one reason he turns to louisville is because of bigness. harvard was now too big. what he wanted was not one big harvard but a lot of little harvards as he put it and the university of louisville was to be his experiment. he and his brother in louisville, alfred, took the lead in raising money. brandeis arranged for

>> well, he lived in louisville until 19 -- 1873. then his father sensing the great panic that was coming closed down his business and took the family to europe for three years to visit relatives and to teach their children about their lives there. when brandeis came back, he entered harvard law school. and after he graduated harvard except for one year in st. louis he practiced law in boston until his appointment to the court in 1916. then he lived in washington the rest of his life with a summer home on cape cod. >> did he actually get an undergraduate degree anywhere? >> no. he didn't. and you didn't need an undergraduate degree to get into harvard law in those days. he did go to a german school for a while. and at that time it would have been a cross somewhere in between high school and college, though, he got some post-high school training, if you will, but he never had a b.a. >> how many of the -- i know he has two daughters. did you meet either one of them? >> i did. i met them in the 1960s. we went up to cape cod to the summe

sergeant robert biven is a spokesman with the louisville metro police department and joining me now by phone. give me an idea, mr. biven, right now, what are your preliminary findings on this investigation? >> well, as you stated, fred, we got the call just prior to 5:00 a.m. this morning to respond to the back side of churchill downs. we are in a very preliminary stages. we do know there were about 400 people located in that area last night. so we are trying to speak with as many people as we possibly can. at this point we still have been unable to identify the individual. we do believe he's a hispanic male, probably in his 30s or 40s, and that is all the information we have on his identity at this point in time. we have a few leads coming up and we're certainly following up on those and after an autopsy is conducted in the morning, we'll have a better indication of cause of death. >> is there anything on this body that indicates this person was an employee there on the grounds? >> there is nothing indicating that at this point in time. just to give you some type of indication of what
