bill: i'm jon scott. attorney general eric holder found in contempt over his refusal to hand over documents relating to the fast and furious gun-running scandal. 255-67 to hold the attorney general in criminal contempt. they held a second vote holding him in civil contempt. >> 258. the nays58,. bill: the attorney general is reacting to this. he blames politics. >> this is a misguided and politically motivated investigation during an election year. martha: the justice department's inspector general will issue a report some time in the next few weeks. for now here is some of what we do know, jon. bill: fast and furious launched in arizona in september, 2009. two months later atf agents observed notorious gun runners buying weapons without stopping them. two months after that atf agent john dodson blew the whistle sparking an investigation by the judiciary committee. on september 14th of 2010 border patrol agent brian terry was shot and killed with a gun that was involved in the fast and furious operation. i

jon: i'm jon scott. both republican governor scott walker and his democratic challenger from two years ago, milwaukee mayor tom barrett have cast their ballots this morning. they join millions of voters in that key battleground state trying to decide whether governor walker should keep his job or whether barrett should replace him. the drive to recall walker began after the he released his plan to balance the budget in 2011. it called for stripping most public workers of their collective bargaining rights. that move sparked massive protests across the state and made headlines across the country. voter turnout expected to be high, near presidential election levels. the results could give president obama and governor romney a glimpse what's to come in november. but that's not all. primaries underway right now in six states and there are some key congressional races to watch including ones in california and new jersey that pit democrats against each other and have president obama and former president clinto

i'm gregg jarrett in for jon scott. jenna: good to have you, gregg. this after a attorney general eric holder could not cut a deal on the department of justice records sought by congressman darrell issa who is currently on your screen there. he is the chair of the house oversight committee. let's go ahead and take a listen. >> if the gentlelady would allow me to continue, when it comes to the question of postponing today, had the attorney general yesterday turned over the documents he said he would return over in return for essentially an ending of this investigation, had he turned over those documents we would not be here today. we would be evaluating those documents but until we evaluate documents that tell us that we can bring a close to either contempt or to the entire investigation, we can't assume that and of course as you know, or i hopefully the ranking member would explain, there was no log or actual documentation showing what they intended to present. i did go into that meeting yesterday would full intent we would likely postpone based on so

gregg: i'm gregg jarrett in for jon scott. we don't know which way the justices will rule as one of them said recently, those who know aren't talking, those who are talking don't know. jenna: and we know what category we're in, right? the ones talking that don't necessarily know. we do have some rare audio, though, of the supreme court justice doing just that, talking about the case during oral arguments. shannon bream's all over the story. she's live in washington with more. shannon? >> reporter: hi, jenna. there are several parts to this case, so a quick recap. you may remember day one focused on whether this case is even ready to be decided or if the court will wait until someone refuses to comply with the mandate, then have to pay the penalty and then sues. that would stop this entire case in its tracks. so we do expect the jus us diss -- justices have moved beyond that and will get to the heart of the matter, whether the mandate is constitutional or not. if it's struck down, they get to severability, whether the rest of t

jon: bigging on the way, i'm jon scott. gearing up for what could be the most important ruling maybe of this decade. both are looking for a political bounce, so what's the impact on the election if the court upholds the law or strikes down all or part of it? michael barone is senior political analyst for the washington examiner, also a fox news contributor. michael, something that i read from you seems to suggest that you don't think whatever happens is going to be good for the president. >> well, jon, i think that you would -- the president's all prepared to go out and say, look, the supreme court has not decided this wonderful law that's going to provide you with so many benefits. the problem with making that argument is that most people don't like the law. it, obamacare, the patient protection and affordable care act, has gotten increasingly negative ratings from the voters in polls, and we've got two-thirds saying they want it ruled unconstitutional. so i think that an attack on the supreme court -- which the president

i'm jon scott. we will take you live to capitol hill where attorney general eric holder is facing new questions about the botched gun-running operation that sent weapons into mexico with deadly results, weapons later linked to the murder of a u.s. border patrol agent. today's grilling comes on the heels of new evidence in the investigation, including wiretaps approved by holder's second in command. they suggest that justice department's leadership knew more than they admitted to congress about the gun-running operation. today judiciary chairman lamar smith says he wants to get to the bottom of what the white house knew. >> did you yourself not inform anyone in the white house about operation fast and furious? >> i'm sure there was contact between staff, and the justice department, probably and the appropriate people in the white house about fast and furious. i don't remember, myself, ever sharing that information with -- >> how would anyone in the white house have learned about it, and who would hav
