n nbc bay area's bob redell is live in santa clara with the details. bob, good morning. >> reporter: good morning to you, marla. the dmv computer system for the entire state went offline, shut down around 7:00 this morning. they do not know yet when it's going to be coming back online. and this shows you just how much we rely on machines. but because of this computer crash, it is effectively shutting down their offices throughout the state like this one here in santa clara, which is why you've got long lines of people hoping that it comes back online soon, even though they don't know when it's going to happen. so the dreaded trip to the dmv isn't wasted. some people aren't even bothering. dmv workers here say roughly about 10% of the people have given up waiting and gone home. the dmv is still conducting driving tests and those results are recorded on paper and can be punched in the computer at a later time. if you need to, say, register a car, get a new driver's license, transfer ownership, you're out of luck. >> i had to pick this day. that's my luck

bob redell is outside the courthouse in san jose. bob, what's the latest? >> reporter: well, good morning to you, jon. both sides did meet before the judge this morning here in san jose, but the judge issued no rulings. he continued this until september 17th. at that time, he would like to decide whether thomas kinkade's girlfriend should have to pay to continue living at his estate or whether she should have to move out. amy pinto has live there since kinkade's death while the estate has paid the bills. his estranged wife, nanette kinkade, is in a fight with her over the estate. her attorney said pinto has ignored two invoices for july and august, refusing to pay. the judge will consider three options. he said pinto either, a, pays rent, that the kinkade lawyers estimate to be at $12,500 a month, b, she pays the mortgage and property taxes, or c, moves out, even though she's refused to do even though nanette kinkade has asked for a leave effectively holding the estate hostage according to the attorney. >> her family residence is being kind of taken over by

nbc bay area's bob redell takes a look at how city leaders plan to deal with the escalating problem. >> reporter: within the past several hours another person has been shot in san jose. officers found this man with at least one gunshot wound around 9:00 last night on the 1600 block of east san antonio street. last report from police, his injuries are possibly life-threatening. no arrests yet. if you look at what's happened in san jose since monday, there have be has been a lot of violence. this map shows the locations of where four people were murdered last week. monday a man was shot to death in his car at charles creek and oakland road. late they're day, a man killed a woman using a samurai sword outside a wallgreens, a vigil for her tonight. a 21-year-old man was also shot that day. he ended up dying wednesday. and then yesterday morning, another man was shot and killed. that taking place near south winchester. that is four homicides. doesn't include other crimes in which people were seriously hurt. >> the gangs are just getting ridiculous out here. that's all there is to it. >> i

bob redell is live in sunnyvale with this story. bob, good morning. >> reporter: good morning to you, marla. yes, berkeley already enacted this bicyclist anti-harassment ordinance, that was in february. sunnyvale's enacting it today, making sunnyvale the second bay area city to do this. this ordinance gives protection for bicyclists against menacing drivers making it a civil offense in addition to it already being a criminal offense. that harassment, whether it's an assault, a threat, an attempt to distract the cyclist to cause them harm, to run them off the road, that as i said is already illegal in the criminal sense. if you're 18 criminal court it's a burden of proof that's higher, higher to prove those crimes, that's why they enacted this, because it gives lesser burden of proof in a civil court. the ordinance gives cyclists more power in court if they decide to sue the driver and gives the judge the authority to triple the amount of damages awarded if the bicyclist should win. sunnyvale likes to point out this is part of making
