reporting live in vacaville, christie smith, "today in the bay." >>> 6:33. california's supreme court is now refusing to overturn the conviction of a former b.a.r.t. police officer. the state's highest court turned down an appeal jed by johanes mehserle. he was convicted back in 2010 in the shooting death of oakland b.a.r.t. passenger, oscar grant. mehserle said it was an accident, but jurors ruled he acted with criminal negligence. mehserle was later paroled after serving 11 months in prison. his lawyers will now ask the federal courts to overturn his conviction. >>> after six very tough months, the search for missing morgan hill teenager sierra lamar now being scaled back. the mark klaas organization says from now on volunteers will only conduct searches one day a week on saturdays. previously they were searching every wednesday and saturday. volunteers will now use wednesday to help identify new areas that they can possibly search. sierra, if you recall, vanish e back on march 16th. the suspect in this case will appear in court later on this month. at thi

christy smith is live in union city where that chase has finally ended. good morning. >> good morning to you. that's right. that pursuit ended here at the intersection of dakota road. they're telling a really scary story that it was late last night. a man in a truck approached them and tried to get them inside. they felt that he was trying to kidnap them and was just very persistent. three men ages 19 to 20 years old, they say they were the ones that were approached. this started in freemont. after 10:00 last night. investigators say the young men were able to flag down an officer. this is fortunately right by the police department where it happened. two of them told the officer they got separated from their friend. they actually saw the dark truck go by and told the officers that's it. >> officers got in a short pursuit through freemont. and north into union city, down mission boulevard to da cato road where the police ended in union city. >> that's where the driver in the truck crashed and bailed out on foot. an officer tackled him. both of them suffere

christie smith is live with the changes that are about to come. good morning. >> reporter: good morning to you, jon. residents here in berkeley say that frankly, they are tired of seeing it and that is someone who is clearly not disabled using one of those blue disabled placards just to get one of the parking spots up front especially in downtown berkeley where parking is so tixt so starting today police are saying no more. they are going after placard abuse. what's different is that because of a recent change in the law, parking enforcement officers now have the authority to ask drivers for identification and evidence that they can legally use that placard to park. in the past only police officers could do that. berkeley's police chief is trying to protect the spaces so people who really have disabilities have those spaces available when they need them. go ahead and find a spot and pay that parking meter. if a driver is caught using one of those placards illegally the placards could be taken away with fines up to $1,000. christie smith, "today in

"today in the bay's" christie smith joins us now from antioch. good morning. >> reporter: good morning to you, marla. the worst of the damage is on the street side of the strip mall. it burned all the way up to the roof, burned bushes and a tree out here. there are crews out here now working to clean up some of the damage. this is just one fire. when firefighters arrived, they saw smoke and flames and realized that this was actually two different fires burning on the exact same property. opposite sides, though. started around 10:40 last night, turned into a two-alarm fire. what makes this really odd, though, is that about an hour earlier just a few blocks away near antioch high school, there was a tree that caught fire. this is all under investigation. but firefighters say it certainly looks suspicious and looks like it could be arson. reporting live in antioch, christie smith, "today in the bay." >>> abused, neglected and left for dead. this morning a morgan hill pit bull is now looking for a little bit of love and a brand new permanent home. th

christie smith is live in oakland and she has all the welcome details. christie, good morning. >> reporter: good morning to you, jon. you know we're out here by a coffee shop in oakland. i have to tell you this is coming out by break news. people getting it by text, hearing on their cell phone and it's about time, those are the words that we keep hearing over and over again from niners fans and raiders fans recalling that green bay game, saying they certainly don't want that kind of call to happen to their beloved teams here in the bay area, so they are very excited that the regular nfl refs are expected back on the field, as you said, tonight for a game. after refs -- or nfl and the refs union announced that a tentative agreement had been reached to end that lockout, the replacement refs, sparked a twitter frenzy outrage putting it mildly after a missed call on the last play at seattle monday that cost the packers the game. the tentative deal is eight years. still needs to be ratified, though. that's expected to happen this weekend. in one online report

christie smith has the latest on this investigation. good morning. >> reporter: good morning to you, jon. you know, you can still see the impact of this deadly wreck here in front of the marriott on north main. that truck was wedged between this pole and a planter and the driver could be in court as early as today. we should learn more about that after 8:00. a 53-year-old walnut creek resident was arrested for vehicular manslaughter. he actually had to be cut from the pickup truck after the wreck. what appeared to be a family was walking on north main saturday evening when a pickup truck ran into them. 52-year-old sherri hicks died. she was a santa barbara mom. she was actually on vacation here in the bay area to see her son and his new wife. the daughter-in-law, also hit, last listed in critical condition. now, hicks was a schoolteacher. friends say that she certainly gave her students her all and will be missed. i did speak with a couple of workers at the marriott who say they weren't here, it was appear opposite shift, but they are c

christie smith is live in oakland with a look at what's being done to restore this memorial. good morning. >> reporter: good morning to you. this is really painful for people who lived through the oakland hills fire storm in 1991. as you said, this isn't the first time that someone vandalized the memorial sculpture. it's the third time. and this time someone cut off five of the metal poles here. despite the fact if you look here, there are clear signs saying that there are security cameras in use. the committee that developed the fire storm memorial garden is hoping that the tape from the cameras might identify a suspect. overnight saturday or early sunday someone took the poles down, they cut them, possibly to sell for scrap. they represent trees and regrowth from the oakland hills fire storm where 3,000 homes were lost and 25 people died. the committee is trying to now raise about $5,000 to help maintain the security system they have, perhaps upgrade it and try and repair the sculpture. reporting live, christie smith, "today in the bay." >> a man is dead after another offic

christie smith live with more on the wounded officer. good morning. >> reporter: good morning to you, laura. you know, there is still so many questions on what happened out there on the freeway. why that suspect opened fire in the first place. here at the medical center, i can tell you that family, friends, and fellow officers are pulling together for critically injured chp officer. he has extended family here from southern california at this hour and there has been an outpouring of support for him. dozens of officers in and out of the hospital since right after the shooting. we are learning more about him. he served seven years with the chp, a dedicated father of four. shot early yesterday morning in a traffic stop on 680 in alamo. another officer shot six rounds at that suspect who then died at the hospital. fellow officers immediately came to help and continue to. >> i can't even name the badges from the agencies that were present. they're offering their support. >> now, the contra costa county sheriff's office is among the agencies i

christie smith joins us live from santa clara. some are saying the attack was retaliation for worldwide muslim protests. good morning. >> reporter: good morning to you. yeah, that's what one of the witnesses thinks, and she says she saw the whole thing. a group was at a booth, an islamic booth, and a man came up out of the blue and started shouting anti-muslim slurs at them and this went on for at least two minutes with the man saying you're all terrorists. that was this past weekend at the santa clara art and wine festival. she and other muslim volunteers were handing out literature when the man walked up. then she says it got even worse. the man took a swimming and punched a volunteer right in the eye. >> i hope that justice is served because it is not okay, especially in america, it is not okay just to come up to someone and to punch them because we are expressing our freedom of speech. >> reporter: santa clara police did arrest the man for assault. she believes it's a hate crime stirred up by unrest in libya and other parts of

christie smith, "today in the bay." >> 6:02. a new search is under way for a missing man from lafayette. brett olson disappeared over the weekend, the labor day weekend that is, during an inner tube trip down the sacramento river. his friends have launched a facebook page called let's bring brett home. this page has close to 66,000 followers in 48 hours. twitter has been abuzz with people tweeting and retweeting. the #find brett olson. behind the tweets from howie mandel to miley cyrus. family friends say they are very grateful for all of the publicity, olson is getting on line and they hope that the efforts will pay off big time. >> new this morning, two people are dead in vallejo and police looking for the suspects who shot them. police found the victims in a home on atherton street mere magazine street and i-80. police say the 31-year-old man and 28-year-old woman had been shot. neighbors say they saw two men wearing hoodies running away from the scene moments after hearing the gun shots. no word on a motive. >> one of the me

christy smith is live in palo alto. she has more on what police are asking everybody to do. christy, good morning. >> reporter: neighbors here in palo alto have told police they're concerned there are more forced entries going on. most of the time they're getting in easily, going right through an open door or window. new statistics show most of the burglaries are happening in the northwest and northeast part of the city. 26 burglaries in august. 5 so far in september. a jump of 50% over last year. we drove around recently and found people still leaving those windows open. police reminding people to lock them up. there's increasing patrols in the day when these burglaries are most likely to occur. some homeowners say they're considering getting video monitoring systems at neighborhood watch groups, planning meetings with police. police are also increasing their patrols at night when they say that car break-ins are also on the rise. reporting live in palo alto, christy smith, for today in the bay. >>> will consider a new proposal to crack down on medicinal marijuana clubs that

we have christie smith live in san francisco to explain. good morning. >> reporter: good morning, marla. i spoke with the seventh grader here at the summit to speak and learn. she thinks issues are important. having a summit like this. she says she hadn't been bullied, but kids feel defen defenseless against a bully. there are lawmakers and principals and police and the superintendent to talk about strategy. this is a community issue. this is a two-day summit here in san francisco where thousands of students who had taken a pledge to stop bullying. the district shows thousands a film called "bully." the film addresses bullying and an 11-year-old who committed suici suicide. school officials saw it before the school year started. by the end of october, most of the kids will have seen the movie. one involved in a solution is glad it is finally being addressed. >> the bully is powerful at school. he or she is dominant. they will crush your reputation. they will bully you. >> bullying takes on a much bigger hit now. it is important for students

reporting live, christie smith, nbc bay area news. >>> the man accused of robbing the home of steve jobs is facing a hearing. he was expected to enter a plea today, but that has been delayed until october 17th. we have a crew on the way to the hearing and we will bring you the latest. mcfarland is facing charges of stealing and jobs' wallet from his home back in july. >>> the red cross is helping people after flames tore through their apartment complex in the south bay. firefighters were called at 4:30 this morning to a fire in san jose near west capital expressway. a second floor unit was damaged by the two-alarm fire. investigators say one firefighter suffered minor burns, but he is expected to recover. one resident was treated for minor smoke inhalation. people said they did not have much time to leave. >> living in the upstairs unit. there is an upstairs deck. it was coming out the deck and there is a tree. it burned quickly. >> did you see the flames? >> oh, gosh, gushing out of the window up there. we thought it would get ours, but they didn't. they found my cane. >> the cause of t

we have christie smith live from cal with more on his life and service. good morning. >> reporter: good morning to you, marla. shock and outrage. that is what i heard from one professor here. she had been communicating with chris stevens. he graduated from piedmont high school and graduated from u.c. berkeley in 1982. the spokesperson said they will release a statement about this very soon because u.c. berkeley has been fielding calls over the ambassador who was killed when he and others went to the embassy to evacuate staff as they came under attack. in the video introducing stevens, he mentioned growing up in california saying i did not know much about the arab world. he traveled to africa as a peace corps volunteer. a statement was released offering condolences to the family. the two communicated when he was appointed ambassador. >> to have served as a united states ambassador is the highest honor and for a lawyer to engage in that type of public service and to have made a career in public service, that is what the profession is about at its best. >> r

christie smith has a look at what's being done. good morning. >> reporter: good morning to you, marla. you do have to wonder what someone is thinking when they do something like this. this isn't the first time. it's the third time that someone has damaged this memorial sculpture. if you can pan over here, someone cut five metal poles off the structure. this happened even though it's pretty obvious that they have got security cameras up near the whole thing. the committee that maintains the oakland hills sculpture is hoping that the cameras might provide a clue to whoever did this. more than 3,000 homes were lost in the 1991 fire, 25 people died. again, some time over the weekend vandals cut the metal off of theç cup tur which represents trees and redproth after the fire storm. in the past the committee said that vandals may be trying to sell some of this for scrap but it's disheartening for the families who suffered through the fire storm. what's happening is that the committee is trying to raise $5,000 to maintain their security

. >> we have more with christie smith. >> reporter: good morning. this is the first time that all of the agencies looking into the chevron refinery fire are here under one roof at the air quality management district offices in san francisco. they are talking about what they found out so far. there are community groups represented here saying they want a clearer picture of what it is they are really breathing over in richmond. from the bay area air quality management district, they want that information particularly after a massive fire. it is standing-room only with each agency, including the safety board and chevron represented here. smoke on august 6th sent a huge plume of smoke in the air. thousands turned up at hospitals complaining of breathing problems. the air quality management district said samples were below state exposure levels. one agency said it was above the normal range within the bay area. bottom line, citizens want the system improved. >> it is not set up to service emergency incidents like the chevron fire. we are looking at incre

we have christie smith who spoke with the family about the reaction to the new law. >> reporter: good morning, laura. doug and linda studebaker wrapped up the press conference. their 19-year-old son was killed after partying on a party bus. today, they are celebrating preside the fact that governor jerry brown signed the bill into law. it is called the brett studebaker law. he was three times the legal limit in 2010. the bill now requires that party bus operators ask the person making the reservation if alcohol will be served and if anyone is under 21. they also have to check identification. none of this was required on the night that brett went out to celebrate a friend's birthday. >> i feel happy that something good can come out of something so bad. >> i think it's nicely put. we feel brett's presence quite a bit. we know that brett is smiling down on this day. >> reporter: now they spoke at the family home near the tree house that brett helped his father build. the law allows penalties against the chaperon and driver and company for failing to comply. another bus in july heightened

we have christie smith out there as the crowds greeted the shuttle. quite spectacular, christie. >> reporter: absolutely. the crowds have thinned out because it happened 20 minutes ago. we got two passes as the "endeavour" passed by the golden gate bridge twice. people said they would scream and yell and actually there was just a moment of silence as it went by. people were taken by the moment. then we heard the roar of the crowd and applause as the shuttle "endeavour" flew by the golden gate bridge the second time. people gathered at chrisrissy f were not sure if it would come back. it went up north to marin and an across the golden gate bridge south. amazing to see. it was one of five shuttles spent between 1981 and 2003. people got here early at crissy field to see history. they shared their personal stories. i was watching with three ladies and here is their reaction. >> it was amazing. i would not miss it for the world. something epic and be able to be part of it. breathtaking. >> i was emotional about it. i remember seeing "columbia" launch when

that is where christie smith is live for the ceremony. >> reporter: good morning to you. they have the gold shovels out here marking the complete transformation of the area. the officials here and all of the steel you see piled up in the background will be driven into the ground. there are four separate projects happening at the same time in this area to make way for the b.a.r.t. silicon valley extension, including widening mission boulevard to six lanes between 880 and warren springs and building the ramps and depressing warren avenue and b.a.r.t. bridges and union pacific railroad. this is a joint project paid for with state and local and federal money. reconfiguring the lanes so b.a.r.t. doesn't compete with other traffic in its design. >> we have b.a.r.t. going under or over. we are depressing warren avenue under the future b.a.r.t. operations and the significant added benefit will be depressed under the current railroad operations. >> reporter: this gives you an idea of what warren avenue will look like. it will become an underpass. the project received about $10 mil

that is where nbc bay area's christie smith is. christie, we're hearing just heard from the school's district superintendent. what's happening out there today? >> reporter: good morning. everyone seems to know this particular teacher and to say that they're shocked is an understatement. the superintendent says she knows him personally. this is a copy of the letter that went home to families here. without really going into detail about the allegations. a lot of people we spoke to said they want to reserve judgment until all the facts are in. >> he's one of the best teachers here, very well-loved. and our hearts go out to him. >> reporter: parents are shaken by the news. a popular sixth-grade teacher arrested and now on leave from the district. >> it's supposed to be the best school district. yeah, i'm surprised. >> reporter: 28-year-old james izumizaki was arrested on suspicion of a lewd act on a child under 14. the school's superintendent says the report came to her monday from the high school about an incident with a student. alba
