and the defense counsel, texas has no statewide defender system. texas is not alone. a lot of states don't have statewide public defender systems. in fact, the local bar, local committee of lawyers that rely on getting appointed by the judge, and so if they guess the judge off there is a chance they will get booted from the appointment list. it diminishes the adversarial process. and many of the lawyers that were representing the folks who became my clients down the road actually had never had a criminal case before. it's one thing to have that kind of situation. in this case there's also a lot of cases where people are facing death sentences who have council that have never done any criminal cases. that's the real tragedy in this country. i went down to about four weeks after september 11. i had no idea whether anyone in the area of texas have ever seen a south asian person but it turned out the only south asian person these folks have ever seen was singed good on cnn. and i got asked because of my last name if i was related to him repeatedly. i still haven't met him

texas officials today had bad news for farmers who badly need water. anna werner has their story. >> what you see now, when it comes out of here, it will be white. >> reporter: the operationpe managed by harold ross dries the rice harvested by farmers around eagle lake, texas. b rice has been grown here since the 1800s, but few years have been as dry as the last two. >> we've been in business since 1947. i've never seen anything like this.ever i've never seen a point where we didn't have water enough to plant rice. >> reporter: rainfall in texas is more than 16 inches below normal. rice production statewide has dropped 37%. bu but the number that really counts is 11. that's how many people are not a working at the drying plant anymore because business is off by a third. th in the past, the rice farmers in southeast texas would routinely get water from reservoirs in central texas. >> we haven't had the rains upau north and north of austin. when the lakes are a certain level, they won't allow us to get water or the producers to get water because the lake

the problem is if you look at east texas and west texas we have heavily white populations, where race is the sole predictor. if you look at mississippi and alabama, these are states where he gotten percent of the white vote. so the problem is, if the white vote in texas continues to trend toward the deep south it is not going to be in the next decade. but it might not be for another decade. this is the long-term strategizing. in virginia, they are inviting a constitutional challenge. that will be taken up by the supreme court. >> the weird twist there is, you have the maine and nebraska models in effect now. and the winner of the popular vote gets the two at-large votes. and there has been that plit in 2008. the twist in virginia is it is the winner of the most congressional districts. it is a strange move. there is sort of an admission here by republicans that there is a threat here that if this gathers steam, if the big blue states, if you had that basic maine nebraska model, the vote would have been 276 romney and 262 obama. it is that condensed. in a few numbers of districts and i
