i just spoke with berkeley police. they say this was very unusual. firefighter got a medical cal to a home on dwight way. when they arrived, they were only here for a couple of minutes when someone inside of the home started shooting. a man believed to be in his 80s. one firefighter was hit, grazed but treated at the scene and is recovering. this started around 1:41 this morning, a small home on the 1200 block of dwight way. five firefighters responded to help with this medical call. about ten minutes in, they called berkeley police asking for help and then they called back and said this had escalated. a man had opened fire. all of the firefighters made it out and the man barricaded himself inside. >> it was a very small residence. so i could imagine that the situation was very scary for them but they were able to get out and, you know, luckily this didn't last too long. he was -- did surrender. there was no further incident after that. >> the police recovered evidence from the home. after making contact with this elderly man, there were other people

she's in berkeley where the suspect is actually an 88-year- old man. she joins us with more on that story, good morning. >> good morning the shooting happened in this home behind me on the 1200 block in berkeley were a couple of blocks away. firefighters were called just after 1:30 this morning about a medical emergency. when they arrived an 88-year- old man inside started firing shots at them. one firefighter was hit he was grazed by a lull bet and he was treated on scene and okay. dead not actually have to go to the hospital. the rest were able to escape the home uninjured the shooter has not been arrested at least not yet. instead he's at the spital being evaluated. police say at this point they're trying to determine if he has these sort of mental issues or if he has in fact lured firefighters to his home. >> it is unusual to have this level of violence towards, you know, a firefighter. obviously there's a concern there was this intention or not that will be part of the investigation. we're also interviewing the other firefighters. there was one ot

the berkeley restaurant is one step closer to reopening. crews installing a new structure to the restaurant that was heavily damaged in the fire. kristi smith joins us from berkeley outside the restaurant with what it looks like today. kristi, how is the progress? >> reporter: good morning, marla. building permits have changed quite a bit since chez panisse opened, nowodes require a steel fre. frame is for seismic in an earthquake. the two-story steel frame lifted into place on shaddock avenue, hoisted over trees and bolted in place after fabrication in oakland that took two weeks. the world famous chez panisse restaurant founded by food activist with the idea that food should be fresh, sustainable and local. it was damaged by a fire that started under the porch. since then the reopen date shift add couple of times. today i'm told the looks like june 10th hopefully. getting the steel frame in place, that is a major step forward. >> we just craned in the new face of chez panisse. it's completely welded steel for structural, and it's also set
