ken, let me start with you. why is the prosecution asking for lesser charges to be included in this case? >> because the way it works in florida, the judge is going to read the instructions to the jury. and one side has to ask for lesser included crimes. if both sides don't ask for it, the judge is not going to give lesser included crimes. here the prosecutor wants toe jury to have options. it's smart for the prosecutor to do this. the defense does not want options. they want all or nothing. they're feeling good about their case. that's why they didn't put zimmerman on the stand. so the prosecutor is looking for options for the jury. and the objection by the defense as to the manslaughter lesser included is going to be zero. the defense has no chance in keeping that out. the law is clear in florida. they're going to get that manslaughter lesser included instruction. on the other issue of whether or not an aggravated assault lesser included crime gets read to the jury, the defense has a good argument that they ca

back with me now is seema iyer and ken padowitz. i'm also joined by veteran prosecutor paul henderson. thank you all for joining me. >> thanks for having us. >> paul, what is your reaction to hearing juror b29, maddie, talking about the pain of trayvon martin's family? >> you know, i think that's exactly what the prosecution wanted to impart to this jury. they wanted them in that jury room to feel for and identify with trayvon martin's parents. and so when i hear her saying that she wanted to identify with them, she feels that pain, she wanted to find him guilty, and she didn't know how to get to guilty given the legal standards that she was given in florida law, it really highlights to me i think some of the shortcomings in the presentation from the prosecution because that's your job as a prosecutor is to give them that road map, to give them those signs and give them the tools in that jury room so that they can get to the verdict that you want them to reach. and so it's very frustrating, i think, certainly for them, to hear that

governor jerry brown also issuing a statement, ken. he took offering his deepest concern and sympathy to the passengers on board and also points out the courage and swift response tost first- responders. whose actions he says surely prevented an even greater tragedy. ktvu's john sasaki is live at san francisco general and john i know you have a moving image that points out just how quickly first-responders reacted, but you also spoke with some other passengers who pulled off some pretty heroic efforts themselves. >> reporter: that is absolutely right, heather we have been here all afternoon and it's been a heckic day at san francisco general hospital. for most of the afternoon we walked acrash victims came many one ambulance after another and one young lady i can, maybe 10- 12 years old, arriving in a front seat and a paramedic carried her to a waiting wheelchair very tenderly and she seemed to be in good spirits. we can see she had some abrasions or bruising on knees. all told 53 victims were brought to sf general, ten of them in crit

what do you think, ken, was the most effective there? >> well, there was a treasure trove of lawyer toys used by o'mara. and you know what? normally, and in many cases, they're very, very effective. a good portion of the closing argument he used photographs of each witness and said something about each witness. and it was flashed on a screen before the jury. very effective. the computer animation, i did the first computer animation in the state of florida. the one he used not effective. fell flat. wasn't a good use of animation. but now in the response from the prosecutor, that was brilliant. he turned it around. he had the last word, which that is what he had, and he basically took the items, the toys, the legal, you know, items that are being used in front of these juries, the demonstrative aids and turned it around and smacked down the defense attorney with it. so i thought the last word really was the best word. i think that was the most effective for the prosecutor to basically push aside those demonstrative aids and minimize theory

ken? >> reverend, the reason that he does not get an a plus and gets a c-plus to a b-minus in my opinion, is assumption is a wimpy word. zimmerman didn't make assumption on that night. he made prejudgments. he prejudgments with this young man with a hoodie as being a criminal. he prejudged a whole bunch of things. he didn't make assumption. that's a very neutral word. i didn't like the use of that word. but yes, his theme overall was effective. it goes into the web of lies. that goes to the amounts of second-degree murder. but i agree, you know, with some of the commentators that this is not a very strong case for second-degree murder. it's a much stronger case for manslaughter. so i think when the jury is going to be hearing from the prosecution first, while they have all night to think about what the prosecutor says before the defense closing tomorrow, it would have been good to touch upon manslaughter and insert that in there in a certain way so the jury can start thinking about it with

here is faith jenkin, lisa bloom and ken padowitz. lisa, you first brought this issue to our attention. how important is this in the trial? >> yeah, i've been looking at this all weekend. and let's start with the internal holster. it's worn inside the pants, inside the waistband, and in the back of the pants. and zimmerman would have had a shirt and a jacket over it. now, here is a picture of george zimmerman from the police reenactment where he shows where the holster was. again, on his back, above his buttocks. now that's important because he says at the very end he is down on his back, that trayvon martin's knees are at his elbows. how on earth, then, did trayvon martin see the gun, which i might add is in a black holster. the gun itself is black. it's a very dark night and raining, according to all of the witnesses. and unless trayvon martin had x-ray vision, the story doesn't really make a lot of sense. >> now, ken, you've done 35 murder trials in florida. how important is this if in fact -- and lisa showed -- had us show the pho
