the white house has rejected the request from the afl-cio to change the rules of the obamacare. what the unions are asking is that they want their low wage workers to be able to get, who are part of multiemployer health plans to be able to get subsidies that other low income workers who sign up for obamacare will get. what's the issue there, mike? >> so basically, the issue here is that you have a -- two employers that are competing for workers in low wage transient workforces about. the way a lot of construction work works is that workers are employed for three or four weeks as long as the construction work goes on and then they may be unemployed for some period. if the worker works for two weeks and is unemployed for two weeks, the plan covers their hearing for those weeks that they are unemployed. >> but michael there are subsidies for those plans right? >> let me explain what's happened here is most cruk contractors is less than 50 employees in this situation. and under obamacare, employers aren't -- aren't required to provide health care for workers with less than 50 -- for

. >> richard trumka, afl-cio president joins me now from los angeles. mr. trumka, good to have you with us tonight. certainly you have a big convention next week. a lot of hot topics. the numbers are a little staggering. last year only 11.3% of american workers were unionized. that's the lowest percentage in nearly a century. 30 years ago, 20.1% were unionized. and unions some say are in a crisis situation right now. what do you say? >> i say we are in a crisis situation right now, ed. we're at a crossroads. we can actually look backwards and complain about what everything that has happened and all the things we haven't done, or we can look at ourselves realistically and change and go forward. open up our doors, broaden our support, join with all progressive groups out there and create a situation of partnership where our issues are our issues, not mine and your issues. so we're really excited about opening up the labor movement to our friends and allies and actually building a movement that can rebuild the middle class. >> and how are you going to do that,

richard trumka head of the afl-cio recently told david shuster on talk al jazeera is having unintended consequences on workers. >> the affordable care act does need some modifications. what's happening now is you have employers that the law says if your employers work 30 hours a week or more you got to give them health care. they're restructuring to give 29 and a half hours so they don't have to provide them health care. they're also doing some taxing the nonprofit plans to pay for fosh for-profit plans. so the idea is sound. the country shurlt needs something done with health care. the millions of people who don't have health care should have health care as a matter of right and the act is a good first step. it just needs to be tweaked right now to make it better. >> do you wish that the administration was doing a better job articulating that? i mean you in 30 seconds have done a very clear explanation as to why this is a good thing and yet for whatever reason the white house can't seem to break through that easily. >> i don't know the answer to that. i think on some things the presid

right now the afl/cio says goodbye to 45,000 union members. long shore and warehouse union breaking its ties with the national afl/cio blaming the split on the president's health care law and immigration reform. our chief national correspondent is live with why this is significant. jim? >> hello, jenna. thaerpt. union is so angry over the so-called cadillac tax in obamacare that imposes a 40% tax on generous plans the union gets it's breaking away from the afl/cio sending a letter to their president complaining about many things saying that, quote, president obama ran on a flat form that he would not tax medical plans and at the 2009 afl/cio convention, you stated that labor would not stand for a tax on our benefits. yet the federation later lobbied affiliates to support a bill that taxed our health care plan. now, the cadillac tax is also pushing employers to change the insurance they offer. >> that is a big, big factor. every employer, as soon as the law was signed, said we're not going to pay the cadillac tax. >> so employers are cutting co

our some are seeing the afl-cio approving a resolution ripping the new healthcare law. but many ask, aren't unions the ones who pushed for these healthcare changes in the first place? labor advocate says that's not the case at all. you argue they were supportive of nationalizing or getting healthcare going for everybody but it was up to congress to work out the details and the president, and they saw the details and didn't like it. >> labor saw a situation in which americans pay far more than any other country in the world for health care, with decidedly mediocre result, and saw millions of people not insure at all so they wanted a change, as to do most americans. never been totally happy with the bill. they wanted changes made at the outset over what we're talking about right now, and they were told, i believe, that those changes would be done down the road. i don't think that labor thinks those changes have been done and that's what this is about now. >> neil: when they were championing the law and i was at the democratic national convention, they were cheerleading th

the head of the ainsley earhardt afl-cio is speaking out against it. as you reported a couple of weeks ago, the unions in the meeting of the afl-cio were railing against it and wanted it repe repealed. it's more effective that the labor unions are railing against obama care. this, what we're seeing tonight, is pure theater. it will have no effect. what might have an effect. if you want to attach something on to the resolution you got to have something that the country entirely agrees with. attach on to this a provision that no one in congress and no staffer in congress is going to be exempt from all of the provisions of obama care and they will not be eligible for any subsidies and that will advertise to the country -- because this is all theater anyway. the utter hypocrisy who passed it for everybody else but exempt themselves. that i think would be an effective point but defunding it is not going to happen. >> the point i was making with chuck, it is a signal to all conservatives out there that senator cruz as much as he talks about this and this vot

the afl/cio continues its stunning turn on obama care. the union, early backers of the health care law passed a resolution stating imp lemation will drive up costs of some union sponsored health plans and some workers and employers may have to give them up. bertha coombs has the details. >> scott, union conglomerate aflcio says it still backs obama care with the start of enrollment in just 19 days away. the white house, though, is getting public pressures from a number of union leaders to make changes to the affordable care act. union leaders echoing some of the same concerns. the business community has at their convention. the american federation of teachers worrying its members will see lower earnings with administrators cutting their hours in order to avoid that employer mandate to provide coverage. while construction trades and engineering union leaders worry about the increased cost of the so-called cadillac tax on health benefits reaped by collective bargaining. in their resolution those unions are pushing for preserving high qualit

the afl-cio is stepping up its criticism of the health care law with a strongly worded resolution that demands changes. the resolution says costs will skyrocket for insurance plans that are join jointly run by unions and smaller companies leaving workers no choice but to drop coverage. a union official says the white house made strong pleas for the group not to speak out. unions were some of the biggest backers of the health care law when it was signed back in 2010. >>> new jersey governor chris christie has signed into law what's nicknamed as the pot for tots bill. it gives them greater access to medical marijuana. he signed it after revisions that include requiring at least two doctors including a pediatrician to approve the treatment. it also makes sure that only children have access to edible forms of marijuana. critics say any law that promotes the use of mar juan in is reckless. >>> turns out anthony weiner was right. he did come in first place in new york city's mayor race, well, may not have won the democratic primary but he did take home the honor of being the candidate who sp
