good evening everyone i'm carolyn johnson >> i'm dan ashley the lawsuit blames the firefighters as well as city and county officials. >> dan is here now with a story only on abc 7 news. >> it has been 4 months since the crash and no charges have been filed against the fire truck driver, 43-year-old michael quinn. da office says there's still working the case. but quinn and the city county of san francisco just slapped with this lawsuit. video show what is happened. that 50-year-old jack frazier on the motorcycle at the top of the screen. fire truck blows through the red lit hitting frazier sending him across howard street into a fire hydrant. frazier retained a law firm that specializes in motorcycle cases to file this lawsuit against the city and county of san francisco and the firefighters at the wheel. 43-year-old michael quinn. >> this is a huge case. normally we don't put a dollar amount in the complaint but this is certainly an 8 figure case in our view. >>reporter: lawsuit says michael quinn drove the city of san francisco fire department fire truck under the influence of alcohol

. >> i'm carolyn johnson. abc7 news reporter nick smith is live in antioch on larkspur drive with the late breaking details. nick? >> dan and carolyn, this remains a crime scene. we are here on the 2700 block of larkspur drive. we understand a man was walking his dog in this block, two dogs actually when he was attacked by two dogs who charged at him from an open area. in the midst of the screens and the calls for help, neighbors responded to all of the commotion. those dogs turned and attacked at least three other people. all of the victims suffered bites to their extremities, arms, legs and face. residents in the quiet neighborhood were frightened by the screams. >> i saw cars everywhere honking and people screaming. there was a bunch of cop cars out here and i was scared. i heard gunshots and i ran inside. i was really scared. >> when officers arrived on the scene the dogs urn ited from the people they were attacking and charged at the officers. the officers fired four shots killing one of those dogs here a

. >> i'm carolyn johnson. it happened at the uh rine do bart station and that's where alan wang is for us. alan, the train is still at the station? >> yes, you can see it behind me, carolyn. it is dead on the tracks tonight. that's because a 1200-pound part of the train melted off while they were fighting the fire. and now it is jammed under the train. they are using saws to cut it into pieces and firefighters say it could be awhile before they get it off the tracks. none of the passengers seemed to realize the bart train was ty on fire until they stepped off at the uh rine do station just after 6:00 p.m. >> came out and you can see the smoke. it was pretty dark. you could smell that there was a definite burning rubber. >> one passenger shot this photo of smoke coming from the train as passengers got off. a drive shot these photos of the smoke from along highway 24. >> there was a small amount of flames under the carriage. >> the 10-car train was immediately evacuated. >> everybody was calm. there wasn't anybo
