this is where the victim's car ended up here in front of this fremont bank on mission boulevard. you can see police have this whole area taped off. the victim's car has several bullet holes there inside of it. let me explain what happened because it is a little bit confusing. earlier this morning at about 5:25 police tell us there was a road rage incident on the lanes of 680 southbound. the victim, who was in the mercedes, pulled off of the freeway and exited mission boulevard, he got off near brown street, when he was there he got into some sort of confrontation with the other vehicle. the suspect vehicle. he was then shot several times while sitting inside of his car. he don't know which way the suspect or the suspect car went. we do know that the victim then went down the block on mission boulevard, pulled up to the fremont bank in front of a doughnut shop, apparently he called 911 and was yelling in pain, the clerk from the doughnut shop we are told also came out and called police. he was transported to a local hospital for his injuries. we are not sure just how badly he was

fremont police did not charge the employee. >> a san francisco man who authorities called the poster boy of crime in the city has been implicated in an august killing. the 36-year-old wilson is charged with killing otis at a housing complex in august. he was a suspect in the 1999 killing of a man in bayview but there wasn't enough evidence for the d.a. to follow charges. wilson will be arraigned for the murder later today. contra costa county will go after $80 million in state grant money to expand the jail in richmond. the county wants to add a 240 cell high security facility to the jail. the sheriff believes it will cut the number of people who commit crimes after being released from jail. the proposed facility would offer more space than what is available now at main jail in downtown martinez. >> the final countdown is on for congress to act to end the government shut down and avert a treasury default. the house of representatives and senate adjourned without a deal to avoid default and re-open the government. senate leaders harry reid and mcconnell have restarted negotiations aft

kpix 5's len ramirez at a fremont donut shop where that victim turned for help. len. >>> reporter: fremont police have updated the suspect description in this case. they are looking for a hispanic or portugese male 25 to 35 years of age driving a white car with large chrome rims. they believe that is the person and the vehicle involved in the morning road rage incident. after apparently tangling on the road they took a right at brown road and there police say that one driver opened fire on the other. >> the victim was in his vehicle. he likely pulled up alongside of the suspect who shot at the victim out his window or door. >> reporter: at least one bullet hit the victim in the abdomen but he was still able to drive to find help at a donut shop a few blocks away. the shooter's car has not been seen since. >> i hear the customer come here they say that, outside somebody shot on the car. so they call the police. we called the police. >> reporter: the man was in the car and the dog was unhurt and the mercedes had gunshot holes in the doors and windows were shattered

the justice department targeting an apartment complex in fremont. ktvu's joining us live now to tell us about the federal lawsuit and how it involves child's play outside that apartment building. janine? >> reporter: dave, we're here at the woodland garden apartments. there's 37 units here and families live in some of them. but federal officials say that owners and staff here are not allowing children to play in a certain area and they're saying that's discrimination. now the u.s. department of justice has filed a lawsuit against the owners and operators of the woodland garden apartments alleging they discriminates against families with children. the suit says they prohibited kids from playing in the common grassy areas of the complex and that is in violation of the fair housing act. the lawsuit arose because five families with children filed complaints with the department of housing and urban development. the staff at the complex was reportedly concerned about landscape being ruined. the suit seeks a court order barring future discrimination by woo
