you have to remember, when she talked about senator nelson, that's ben nelson, the former senator at the head of the national association of insurance commissioners, state regulators for these companies. they spent three years thinking obama care was going to be the law and building up a structure to deal with that. now, with the president's news conference on thursday, that all goes out the window. >> chris, this has reached truly crisis proportions. is there any indication from your interviews that it's going to go back in the direction it was intended to? >> no, i mean, they're just dealing with what the president has told them. and some companies, some regulators have said they're just not going to play. they're not going to reinstate these policies. they have gone too far. there are other companies and other state insurance commissioners who have said they are going to try to reinstate them. again, even if you get policies reinstated, that means a lot of people who obama care was counting on, the obama administration was counting on joining the exchanges and joining the risk poo

in terms of the new announcement, the state new year's commissioners as ben nelson said will decide what the rules are in the particular state. our members are going to work very, very hard to try to support their customers to provide them options at the same time making sure that the new market will be affordable and that's the key point. that's why i think there are a range of interests that are very important. insurance commissioners. the insurance industry. health plans, the administration, consumers working together to try to make sure that they can buy affordable coverage and that is the issue. how do we balance those risk pools? who stays out? who goes in? there's a strong interest in talking that out and working on that now so that people can in fact get the coverage that they need and that's what we're focused on. >> senator nelson, let me ask you a blunt question. do you think the president is trying to shift the blame for his promise about if you want your policy you can keep your policy from the white house to the insurance companies and frankly to your insurance regulators?

think of the backhand deal to get ben nelson to jump onboard. that's going to sort of carve out the health care waivers for nebraska. so money has always been a problem in politics. that's nothing new. be worth the republicans waking up to the fact that the caller's opinion about washington is something intensify in the last few years. if 2010 was an anti-incumbent, anti-washington election, 2014 could be gearing up to be the same. that's not all good news for republicans. >> so to your earlier point, from dee dee fredericks, do we know the cost to taxpayers for the affordable care subsidy s? >> we don't. it's interesting that the numbers came out from the health and human services department, i think it was about 106,000 people had signed up through the federal exchange, through the various state exchanges. and signing up for health insurance. more than double for signing up for medicaid which is the -- basically the poor and infirmed health insurance for them. i think one of the miscalculations that the democrats and the obama administration m

nelson of florida, ken salazar of colorado, olympia snowe of maybe and john warner of virginia. what they devised was a quite simple solution. they were grappling with the same question that confronts us now, what can justify a member of the united states senate voting to block consideration, in other words, to filibuster, a nominee to the judicial branch. and their idea, simple as it was, had tremendous power. they agreed they would oppose a judicial nominee only in, quote, extraordinary circumstances. that was the gist of the agreement, there were other features to it but their spirit and intent in this short phrase had profoundly meaningful impact. in fact, for the remainder of the bush presidency, there were no more filibusters on judicial nominees. and those senators with that short phrase accomplished a historic impact. what did they mean by it? as one of them said at the time, -- quote -- "ideological attacks are not an extraordinary circumstance. it would have to be a character problem, an ethics problem, some allegations about the qualifications of a person, not an ideo

the topic of our conversation with former senator ben nelson. he is now the ceo of the national association of insurance commissioners. here is some of our conversation with him. >> what the concern is about having the policies extended into the next year -- some people will decide to do that, some will choose not to, and there is always a concern that people with health conditions all the ones who will want to extend the coverage and others will choose to opt for other coverage. what that risks is and as we are finding out, now there will be ,oo different of individuals the pool of those who are having their coverage extended, and then the other pool, which is a larger pull, of people who combine policies in going into affordable care act as a result of going into the first of the year. this is a challenge because under the law, based on the law of large numbers, what you want is a large pool so that you don't end up with people simply with health conditions, or that will skew the rates, make them much higher. can watch all of the interview wit

we have senator ben nelson with us, he is now the ceo of the national association of insurance commissioners. senator, welcome to the program. it's very good to have you with us on a day like this, sir, welcome indeed. >> well, thank you, stuart. good to be with you. stuart: so what is the insurance industry's response to the president's fix? >> well, i'm not really in a position to respond to the-- about the insurance industry other than i do know that they have met with the president in the white house to talk about how they're going to react to it. stuart: okay. just from the insurance commissioner's point of view. >> the regulatory-- pardon? >> it's a regulatory thing. now, from the commissioner's point of view and you chair their organization, what do the commissioners think about this? just let's keep your plan, what do they think about it? >> well, the commissioners have-- are concerned about what the president has suggested because it is a suggestion if you follow it because it's not a-- it's not a law, it's not mandatory from washington, all the the president has said in the hhs hea

you think about the cornhusker deal with ben nelson in nebraska, all the different states that fought for exemptions from it in order to get the vote to say yes, and it was a very, very heavy lift. >> every little thing made a difference. and there are three key lies the president said. and i usually don't like to use that word, but i think it's appropriate many this context. he said if you like your insurance, you can keep it. that was a lie. he said if you like your doctor, you can keep your doctor. that was a lie, because if your insurance changes, your network changes, and your doctor is not necessarily in there. and he basically said everyone was going to safe money on this -- save money on this, and a lot of people are going to pay higher premiums. so we're seeing the reality of this law, and it is just devastating that at most the most generous estimate is after a month you have 100,000 people which is 80% short of their target. when millions, several millions of people are getting their insurance canceled. so there is some chance that this thing could end up unraveling, becaus

nelson in nebraska, they vote with republicans all the time this sort of thing. you actually spoke and pursued a fairly progressive agenda in montana, in a red state, and it didn't cost you -- didn't hurt your popularity, only helped your popularity. what was the key, tell us about that experience? >> you have to explain what you're doing. for example, when i took senior citizens across the border to buy their medicine in canada because canada sells it for one-third, what conservative would be against that? i guess the ones who would lobby us for the pharmaceutical companies in washington, d.c. would be against that. when i proposed to spend more new money on education than any time in history and reform education in montana and then ultimately montana increase the percent of our adult population with a college degree at the fastest rate in the country, who would be against that? when i built the eighth largest budget surplus in the history of the state while i was governor, who would be against that? but we also took care of children's health. we also reformed t
