that's a tease, greta. what was he saying? >> you know, there's so much of it that you have to read into it, neil, because he is very fragile, he's very hesitant to say anything bad about anyone. but what he talks about in the interview is how he was mocked, humiliated, beaten, terrified, solitary, tied down in this prison. it was just terrible. here you've got a guy who is -- has ptsd, he says he's paranoid. he drives out to the va hospital to get help. two days later he goes into mexico and ends there for 214 days. imagine putting someone with ptsd, paranoid in a cell with people talking about him in a language that he doesn't understand, just hears his last name in their language and mock him and humiliate him. >> he hinted that even authorities there thought he was innocent, which raises a lot of questions, i'm sure you got into. why the hell was he there so long? >> you no, that's a good question. that's what's so enraged all of us at. >> curt: . >> curt: on the record." they didn't charge him with trying to smuggle guns

to greta van susteren. what are we to interpret from the length of time it's taken or the fact it's happening now? >> probably we shouldn't think much about the helping -- length of time because the grand jurors only meet one day a week. so they got this case in august but only been meeting one day a week which is not up usual for a grand jury. so while it may seem like a long time, it isn't quite as long as it appears. >> what are some of the possible scenarios here? >> no bill, meaning no indictment. or an indictarting at the very top, first degree murder, down to a very light manslaughter charge. now, what do i expect is the other issue. being an old criminal defense lawyer, now that it's very easy to indict. this is not the trial where it's proof beyond a reasonable doubt. this is that a crime occurred and that -- and that the person likely committed it, which is far below having to prove beyond a reasonable doubt. also in grand jury, the evidence is prepared by the prosecutor. there are no defense lawy
