judge james spencer was considering the defense's motion on two issues. abduction of justice, whether the former governor did that during his trial and the value of things that they received, the loans and the gifts whether they were valued too high and how would that affect the sentencing? ultimately, judge james spencer ruled towards the defense saying that they ultimately lowered the sentencing guidelines between 6 1/2 and 8 1/2 years. earlier, the former governor arrived with his daughters and son at his side as it was during the trial this summer. he immediately was greeted by a crush of media. he told media no comment to make. this is before. but he would have something to say after the sten sentencing. his estranged wife arrived later, the two no longer live together and she is not being sentenced today and does not like the limelight in any way. she did show up a few minutes later. we want to take you inside the courthouse and show a little bit about the testimony we've heard today. we've heard from a number of character witness. first one that we

spencer christian here now to explain why the fog was so thick today in his accuweather update. >> well, that fog, as i mentioned yesterday and last night, was spilling in through the carquinez delta from the central valley and we had some along the coast as well. it just lingered this morning until it finally burned off. here's live doppler 7 hd we've got mainly sunny skies right now but still fog in the central valley and a few more patches developing tonight but not as widespread or dense as last night. meanwhile high tide at 11:36 a.m. we're still concerned about tidal overflow from the king tides, higher than usual tides, but we don't think that will be a big problem tomorrow. here's a live view from the golden gate bridge. under clear skies right now, we'll see clear skies continuing through the evening with just a few patches of fog developing overnight. we don't expect the same fog we had this morning. overnight lows range from 35 to 48 and highs reaching into the mid-60s. i'll have a look at a big warming trend coming our way in a few minutes. >>> still ahead on abc 7 news at 4

darcy spencer has been working her sources. she has preliminary information, right darcy? >> reporter: that's right, chris. they were set up here. the press conference will get under way here at the anne arundel fire department. we have been able to gather information. this appears to have been an electrical fire that eventually caught the christmas tree on fire. there was a problem with an outlet around the christmas tree. some combustibles ignited including the tree. i'm told this fire went up very, very quickly, described as umtltra fast. there was no way that anyone could get out of this house alive. the tree was 15 feet high and it was very, very dry. we're told a lot of needles were found underneath as well as in the area that collects needles underneath the tree. it provided a big fuel load for this fire to spread. we're told that don pile's body was actually found in the great greatroom area. it was normal for him to sleep on the first floor. his wife sandy and the grandchildren were on the second floor of the home. it appears they all did die from smoke inhalation
