emotion al emotional day in the murder trial of nfl star aaron hernandez. the victim's girlfriend and mother took the stand, but tu jur jury may not have seen the most emotional moment. susan candiotti has more now. >> reporter: remembering a painful day. shaneah jenkins is watching herself on video camera visiting the home of aaron hernandez. she is hugging aaron hernandez and her sister after learning that odin lloyd has been shot dead less than a mile away from the hernandez home. shaneah testifies that hernandez is also in the home that day. >> did he seem shaken up? >> stressed. >> reporter: nine days later, hernandez is arrested for lloyd's murder. the murder weapon is still miss g missing missing. prosecutors show jurors home surveillance photos of hernandez can' fiancee showing something in her hands. >> this eyeitem that she is holding. do you know what that is? >> the black trash bag. >> reporter: authorities suspect that hernandez' fiancee sitting behind him in court is using the trashbag to hide the murder weapon to throw it away after getting a

earlier that evening, police went to aaron hernandez's house. he later goes to the department to answer questions. before he answers questions, the detective testifies that he waited 45 minutes for his attorney to show u. and the man who was in the car with hernandez was actually the attorney who was representing him at the time. but that is a fact that the jury is not aware of. they do not know it was the attorney who gave aaron hernandez that secondary phone. >> alex, i know the defense fought hard to try to limit this video from being shown at all to the jury. the defense lost in this case. it has been shown, a pretty big win for the prosecution. i'm wondering what argument, what the judge said, if anything, in court about why they were allowing this in? >> reporter: well, the only concession that was made to the defense which, as you point out, did not want the video shown at all, was that they would edit out the portion where the attorney gives the phone to hernandez. they don't know it's from his attorney that's no longer representing him.

if anything about aaron hernandez came up they had to turn away. is that really that serious that you would dismiss a juror over? >> no. everybody watched the super bowl. it's the most watched super bowl ever except for aaron hernandez. all of the jurors were allowed to do it. he wasn't mentioned. i don't know what would come out of the super bowl that would lead to a hearing on a juror. something came up where this juror might have information that might taint their ability to be fair. we'll see. we'll learn soon enough. it does happen all the time in high-profile cases because everybody talks about these cases except for the jurors. >> that's why they made alternate jurors. >> that's why we have them. we foresee this situation. if the juror is no good anymore, the next one moves up and takes the place. >> let's tackle the evidence issue that prosecutors have new evidence to bring into trial. that's normal too, right? >> absolutely. what's interesting here carol, is the confrontation clause. they are fighting about whether or not the defendant can

aaron hernandez breaks apart his cell phone into three pieces. the jury will then also see video of him reassembling that cell phone and retrieves a number and then using a different phone. prosecution says he's using that other phone to call earnest wallace. the judge says that the jury will see two parts of the video. one, aaron hernandez breaks down the cell phone and puts it back together. two, they'll know he uses a different cell phone to make that call. what they won't see is what happens in between. aaron hernandez's attorney at the time someone no longer representing him in court, is the person who handed over that cell phone, carol. this is being left out. the defense argued that this video shouldn't be shown because there was attorney/client privilege. but judge garsh ruled there was no violation of attorney/client privilege and that aaron hernandez was sitting in a parked car at a police station. a well lit parking lot. visible there was a surveillance camera outside of that building. there's really no reason to believe he should have

this sounds like a woman who was pro-aaron hernandez, essentially. the judge, after a lengthy discussion this morning, first as a side bar, then dismissing throwing everybody out of the courtroom, hearing evidence and testimony from individuals who came in. one of them may have been a state trooper. this woman, the judge said was wanted to be on this case had made specific references and talked about the case over the last two years, specifically telling someone that the absence of a weapon made it hard for any jury to come to a conclusion or to find him guilty. also saying that she had attended more patriots games than she had indicated on the juror questionnaire. and saying that the recollections of her conversations with certain individuals just were not supported by the facts. in order to get a fair trial and make sure this woman didn't taint the rest of the jury or the process, got to kick her right out. brooke? >> what happens next? minus this juror, do they pop in an alternate? is anyone talking about a mistrial? >> reporter: well no one is ta
