can we start with the release of peter greste? delight, the world over about this, but still huge concern about the fact that mohamed fahmy and baher mohamed are still locked up. has there been any word about any progress on what could happen to these two men? >> yes, indeed. now that peter greste's case is almost certain. all eyes are on baher mohamed and mohamed fahmy, the other two egyptians that were accused and sentenced in this case. for mohamed fahmy, who has a canadian nationality, it was rumored yesterday that was in the process of revoking his egyptian nationality, so we can benefit from the law under which peter greste was released and deported. even though this was denied today, for baher mohamed, who has been sentence ed tod to ten years in prison he has only egyptian nationality, and there were a lot of calls, even from pro-government journalists today on local and private television for him to be one way or another. because they say it doesn't serve the regime it doesn't do anyone any good. because it looks as if he

they've let peter greste go, but of course, mr. fahmy who's position is exactly the same, he's no longer an egyptian citizen, he's a canadian, seven years imprisonment on trumped up charges, he should follow, and so logically and legally, he should be deported next week, and it will be down to the al jazeera one on february 23 now it's before some very poor, lousy judges. in fact at the first level of egyptian authority who are really government officials and know what the government decides, it can get away with. hopefully in any kind of legal system, you have an appeal court, which earlier this week gave its reasons for quashing the conviction of the al jazeera three. it said there was no evidence of terrorism. there was no evidence of any connection with the banned muslim brotherhood so it's the prosecution, which of course is directly linked to the government have any decency or sense of law, they will drop the charges february 23. the court would actually throw them out. we are in a political situation not a legal one. it's as

greste and peter says: let's speak to jeffery robertson. he's a formal u.n. appeals judge. he is joining us from london to discuss this case and what we saw happen in egypt today. the two men released on bail jeffery, what do you expect to happen on february 23rd? >> well the bail release is a small step in the right direction, but it's a step that should have been taken 411 days ago. there is no evidence against these men and the court of cassation, which is the appeal court gave its written reasons a few days ago, saying look there's no evidence they have been complicit with the muslim brotherhood, no evidence they have been involved in terrorism. so what you would have expected today was a big step in the right direction, namely throwing the case out, instead the men have been given bail, mr. mohammed fahmy has to put up $33,000, but as far as he is concerned, there is no difference not a scrap of difference between his case and that of peter greste who was released last week. so mr. fahmy who has now renounced his egyptian citizenship,

peter greste has been released, deported and let's hope that mr. fahmy in the next week or so between the next hearing an february 23 follows him. there's no logical difference between the two men the evidence or non-evidence against them is the same. they've both got seven years. mr. fahmy has now shed his egyptian citizenship so he's a full blooded canadian and as mr. greste is full blooded australian so there is absolutely no difference to i hope the decent and logical thing will be done in the next week and mr. fahmy on his why to his home in canada. today's proceedings do, for all the happiness i imagine that the families have that they are out on bail, mr. fahmy has to post $33,000, but that won't be difficult, i'm sure, for all that happiness we still face a cat and mouse game being played by the egyptian authorities successfully because they have suppressed any reporting of the opposition to presidency see's authoritarian rule, and that was the whole object of this frame-up of innocent journalists going about doing their job what the egypti
