the beach is about, as i mentioned, 20 miles from downtown santa barbara. there is a campground there that's completely booked for memorial day. at this point it's unclear if visitors will be impacted by this spill, since it is on monday. right now it's putting up a strong smell, that sheen is. and it goes without saying that the environmental impact will be significant, although at this point we don't know exactly how major that will be. now, the last major oil spill in santa barbara happened back in january of 1969. that happened in the santa barbara channel. at the time it was the largest oil spill in u.s. state waters. an estimated 80 to 100,000 barrels of crude oil spilled into the ganl so that's a lot more than we're seeing today. public outrage over the death of wildlife presented a number of environmental laws over the next several years. we'll continue to monitor the story and keep you updated on what's happening in santa barbara. you can also track it on nbc bay area our app on facebook or twitter. >>> sex, drugs and now jail. a high-end call girl

. >>> dolphins were spotted swimming in the oily water near santa barbara. they seemed to be swimming in a circle avoiding the oil behind them. governor brown declared a state of emergency for the oil spill. workers in white protective suits and helmets are removing oily sand. crews have cleaned up 7700 gallons of oily water. that's a fraction of the estimated 105,000 gallons that leaked from a ruptured pipe. an oil company from houston, texas is taking full responsibility for the spill. >> we apologize for the damage that it's done to the wildlife and to the environment. we are here to make it right. >> the pipeline leak was first detected on tuesday night and that company plains all american pipeline has been found to have many safety violations. the "los angeles times" looked at federal records and found that the texas--based company has 175 safety and maintenance infractions since 2006. the rate of incidents per mile of pipe is more than three times the national average. and they include pump failures, other malfunctions, corrosion, and operator error. >

for more we go to santa barbara where we are joined by two guests. tyler hayden is a news editor and reporter with the santa barbara independent. and linda krop is chief counsel for the environmental defense center. welcome both of you to democracy now! linda krop, explain the extent of the damage and what is being done about it. >> the spill has had a devastating effect are ready and it is very frustrating. i was at the site the first evening and nothing was being done to prevent the oil from getting into the ocean. it should've been done immediately because the spill occurred about one quarter mile from the ocean. when we got there tuesday evening, the beach was blanketed with a solid array of oil. behind tide was coming in, waves were washing the oil out to sea, which mix of virtually impossible to clean up. they had no shore-based response, no offshore response. they had identified and contained the leak, but they do nothing to prevent the oil from getting into the ocean. now we have dead sea life, birds, a sea lion have been oiled. and who knows

that's where refugio is north of santa barbara right along the water is where the leak took place. it went under the 101 freeway and out into the ocean. they are saying right now, still officially 21 or 22,000 gallons. however, that could expand over 80,000 gallons of oil that may have been spimed out into this -- spilled out into this ocean over the course of two hours yesterday. they are still assessing. as your show was starting, the coast guard helicopter flew above us to assess to get a better idea how much oil went into the water, i can show you what's been done so far. these are some of the bags of sand. they have been scooping it up, putting it in a plastic bag. they are doing the sand first. earlier there was 20 feet of sand. you can see the oil globs on the sand. if you look at the rocks, they are splattered, almost like someone took a paintbrush. this is the area where the oil is coming ashore, that slick is -- some estimates up to eight miles but it's breaking up is why it's gone so far down. the positive, if there is any positive, it hasn't gone into a marine sanctuary

and at least growing criticism regarding the oil spill off the santa barbara coast. anne makovec has more from the newsroom. >>> reporter: insufficient, that's what california's senators are calling the response to that oil spill in the santa barbara area. they are questioning why it took an hour and a half for the pipeline company to even notify emergency officials that there had been a spill. that happened near goleta on may 19. crude spilled down a culvert and into the ocean off the coast. it left beaches black and created a slick 10 square miles into the pacific. california senators are now asking the feds to give more details on the response by the company, plains all american pipeline. now, farther south, beaches along the los angeles county coastline remain closed as the coast guard investigates balls of tar that have been washing ashore this week. clean-up crews have been working through the night to remove them. early reports are that it appears to be about a barrel or two of oil, much less than that massive amount spilled near santa barbara. so it's tough t

>> they believe thet in wind could push it closer to the city of santa barbara. a 1500 boom has been laid out in the water to keep the oil from spreading. >> our sister station in los angeles that is been at the scene all night. >> clean up efforts are underway along the santa barbara county coastline after thousands of gallons of oil spilled into the ocean. officials found the ruptured pipeline on the north side of the 101 after residents complained of the strong odor. the crude oil spilled into a culvert flowing under the freeway and on to the beach right into the water. initial estimates say 21,000 gallons of oil spilled into the ocean before the leak was shutdown. that spill is stretching approximately four miles along the shore. but officials say it could spread another two to four miles due to the wind. the biggest concern is for the wildlife caught in that oil. we have seen whales swimming dangerously close to the slick. at this point, they don't have any reports of animals injured due to the spill, but it is still early in this effort to clean up the mess
