tucker hipps was a sophomore at clemson university when he fell to his death last year. new court documents allege hipps was forced to walk along a narrow railing as part of a fraternity stunt, and his family is accusing the university and three students including the son of a congressman of a cover-up. cnn has been looking into this case. we are joined now with more. good morning. >> reporter: good morning, carol. this is a mystery that's been going on more than a year as the family has been trying to figure out what happened. 19-year-old tucker hipps was found dead in lake hartwell after participating in an early morning run with his attorney. for 11 months people didn't know what happened. did he jump over a bridge? was he forced to jump over a bridge? was he pushed over this bridge? there was a history of forcing pledges to jump over bridges and swim to shore as part of a hazing ritual and we also know from the attorney that the brothers were upset with him that morning because he was supposed to bring mcdonald's breakfast but he didn't have the money to do it. so th

his name is tucker hipps, a student at clemson university. and in the process of pledging a fraternity there when instead his body was found floating in a lake near a bridge. a newly filed family lawsuit has fresh details from someone who said that 19-year-old's death was no accident. cnn's sayer sara ganim is here. where is it going? >> this tragedy has been going on more than a year now and it's been a mystery, did he jump over the bridge, pushed over the bridge, forced to jump? his family attorney says this fraternity had a history of forcing pledges to jump off bridges during early morning runs and swim to shore. we know from the family lawsuit the brothers were upset with him because he didn't have the money to bring them their mcdonald's breakfast. we know three brothers have been charged. one is the son of delaware congressman carney. 11 months later as we approach the one-year anniversary, a new witness is coming forward telling police or leading the family to believe tucker hipps was forced to walk along the railing of the bridge. i

i actually think that once the plaintiff's lawyers get into what clemson knew concerning bridge jumping, and as i understand is common there. >> yeah, there's a history of this happening. >> exactly. exactly. and then if the university knew and if there's an obstruction or if there's been an effort to hide it, that's become part of the case. we're right now in what we call discovery. the lawyers are digging up and finding out from the university and fraternity what the facts are. we're going to be in a lot different position three or four months from now and getting the answers to what everybody want toss know. >> fred the issue is what the university did in reaction to allegations of this type of behavior. what did they do? here they have the rules and regulations against them and prohibited it and when they found out about it they held hearings and suspended and ex l expelled them. that's what a university should do. this is not going to have liability in the case. the question is whetherill the fraternity. >> i don't know how you can say that. >> okay. thank you very much. good to se
