abc7 news reporter melanie woodrow has the story. >> heavily-armed officers from multiple agencies provided assistance in sunnyvale following an officer-involved shooting. around 4:15 someone called police to report suspicious activity during this motel 6. they said had officers approached the vehicles, two suspects began running. an 18-year-old veteran with the sunnyvale department of public safety shot one suspect who was shot dead on the scene, despite life-saving measures. we found additional firearm in the backpack he was wearing. >> one was a loaded high-pass the magazine. other a handgun. >> we don't know if he fired at the officer or not. that would be part of our investigation. >> the officers do not have body cameras, according to the captain. officers involved were not hurt. >> scared. >> the motel 6 guest andrea said

melanie woodrow is outside the jail with more on the story. >> dan, he self-surrendered and released on $100,000 bail. according to the d.a.'s office, brooks is expected to self-sur surrender the next several days. he could do so at the jail or sheriff's headquarters. the grand jury's indictment stems from an incident at 49er ray mcdonald's san jose home. it was 2015 where the victim alleged sexual assault. but they say it took nine months to investigate. >> it seems like a longtime, but when it comes to cases of this nature it is not a long investigation. >> this week a grand jury indicted mcdonald for raping an intoxicated person. the d.a.'s office also charged the current 49er player brooks with sexual battery. the separate assault occurred the same night against the same victim approximately 30 to 45 minutes apart. mcdonald previously sued for defamation after she reported the incident to law enforcement. a suiter attorney gloria allred helped her get dismissed. >> she is courageous and looking for a just outcome in this case. >> the 49ers released him for a pattern of behavior.

melanie woodrow is outside the jail with more on the story. >> dan, he self-surrendered and released on $100,000 bail. according to the d.a.'s office, brooks is expected to self-sur surrender the next several days. he could do so at the jail or sheriff's headquarters. the grand jury's indictment stems from an incident at 49er ray mcdonald's san jose home. it was 2015 where the victim alleged sexual assault. but they say it took nine months to investigate. >> it seems like a longtime, but when it comes to cases of this nature it is not a long investigation. >> this week a grand jury indicted mcdonald for raping an intoxicated person. the d.a.'s office also charged the current 49er player brooks with sexual battery. the separate assault occurred the same night against the same victim approximately 30 to 45 minutes apart. mcdonald previously sued for defamation after she reported the incident to law enforcement. a suiter attorney gloria allred helped her get dismissed. >> she is courageous and looking for a just outcome in this case. >> the 49ers released him for a pattern of behavior.

abc 7 news reporter melanie woodrow spoke with the marin county sheriff's office tonight. and it was an elite group that found her? >> reporter: despite the rough terrain, it made it difficult to find her. she was waiting to be helicoptered home in the morning. saturday morning four people from this marin mountain rescue team found miyuke harwood down this steep ledge. 30 minutes later, the lieutenant got the call. >> very happy, first of all that the person was found and safe. and in this case my team had an opportunity to play some role in that. >> reporter: officials say harwood managed to survive for a week in the remote area of the national forest. the lieutenant called her name, she responded by blowing a whistle. he says that whistle and a water filter likely saved her life. >> if there is one thing you need to survive for a number of days as she did it would be the availability of water. >> reporter: the rescuers that gave first aid carried harwood to a quarter mile where a chp helicopter could land. they flew her to the medical center in fresno to get checked out.

melanie woodrow is live on the scene. what are police saying about the second suspect? >> they say the second suspect is armed and dangerous. right now they believe he has left the area. they spent hours searching here tonight after receiving information he had run toward a home. heavily armed officers from multiple agencies provided assistance in sunnyvale following an officer involved shooting. around 4:15, someone called police to report suspicious activity near this motel 6. when officers approached the vehicle, two suspects began running. an 18 year veteran shot one of the suspects pronounce dead on the scene, despite living saving measures. >> through the investigation, we fond a firearm. and an additional firearm in the backpack. >> one was a loaded high capacity magazine. the other a handgun. >> we don't know if the suspect fired at the officer or not. again that will be part of our investigation. >> sunnyva lchtle officers do n have body cameras. the officers involved were not hurt. >> i was scared. because that i was alone. >> andrea laura was startled. >> fro

. >> melanie woodrow has been following the story and has the latest. >> reporter: sunnyvale officers could release the name of the suspect killed tonight. the other two suspects are from fresno. this is a picture of the outstanding suspect officers say he has an outstanding warrant in connection with a homicide. sunnyvale's department of public safety says one of the officer's lives was in danger as he stood face-to-face with a suspect pointing a loaded gun at him. >> officers were faced with a deadly force situation and responded to it. >> reporter: around 4:15 p.m. someone reported suspicious activity at this motel 6 including two women going back and forth. when officers approached the vehicle they say two of the three men inside took off running. according to captain jeffrey hunter one dropped a high capacity magazine and then pointed a gun at the officer, an 18 year veteran. >> the officer fired nine rounds at the suspect. the officer and the suspect were facing each other at the time of the shooting and in very close proximity. >>> motel 6 guest says she was startled. >> i look

melanie woodrow has more on that story. >> this is good news for drivers because it is all about easing congestion and making the highway safer for those drive the lines are greet so drives can get used to the change. caltran will turn on 20 ramp meters on interstate 680 from highway 101 in san jose to scott creek road over the county line. the southbound meeters are activated this afternoon from 3:00 p.m. to 7:00 people the height of rush hour. this morning, a couple of minutes ago, the northbound side were turn on. they are green from 6:00 am on to 10:00 a.m. to help drivers get used to the change. the lights are fully operational on september 1 so they will be both red and green and same areas from 6:00 a.m. to 10:00 a.m. if the morning commute much metering lights do not have cameras attached to them. >> motorists are encouraged to follow the signals. when it is red, stop, if you go through the signal, that can happen but c.h.p. monitoring the area so be careful. adhere to the red and green signature -- >> caltrain said they have to wait tore all of the electronics to be operational

melanie woodrow has the latest. >> reporter: in this dramatic, exclusive video, you can see those injured while taking him down. the potential terror attack happened on a train traveling from amsterdam to paris. two u.s. servicemen both with sacramento ties heard the gunmen loading a weapon inside a rest room on the train. the gunman reportedly came out shirtless with a rifle flunk over his shoulder. that's when the men sprang into action, wrestling the moroccan gunman to the ground. >> if they hadn't stepped up, there could have been a lot of deaths. >> we are both very proud of them. >> reporter: anthony sadler was the third man who helped thwart the attack. alec yelled, get him. three people were injured. the gunman slashed him with a box cutter. >> he had cuts on his back. they almost cut his eye out. >> his fingers. >> he took the gunman's weapon. they each credit the other for saving his life. >> i would have been killed if it wasn't for alex. >> i talked to alex and alex said the same thing. mom, if it wasn't for spencer, i would be dead. >> the gunman's motives are not yet known.
