amy. >> amy: thank you. on the health watch, more and more children are being diagnosed with adhd, but a new study says a lot of them don't actually have it. the study says that prescriptions for drugs like ritalin have actually doubled now over the past decade. in many cases it's because teachers compare the child's behavior to children who are the study says the percentage of kids diagnosed depends on what month they were born in. kids turns out who were born in september were the least likely to be diagnosed while children born in august have the highest percentage. we all heard it is important to limit how much time your kids spend playing video games. new research shows that playing video games is actually good for some children. research published in the journal social psychiatry and psychiatric shows that playing video games can help kids do better in school or in social situations. a neurologist, is joining us to talk more about that. great to see you. >> great to see you. what types of video games a

i'm amy goodman. after weeks of speculation president obama has announced , his nominee to replace the late justice antonin scalia on the supreme court. merrick garland is the chief judge for the u.s. court of appeals for the d.c. circuit. he is widely viewed as a moderate judge who he has received overwhelming bipartisan support in the past. he is most one of overseeing the prosecution of timothy mcveigh. republicans have vowed to block the nomination of merrick garland. senate majority leader mitch mcconnell said hwill wait until a new president is in place next january before even holding a hearing on a nominee. with the death of scalia, the nine-member supreme court is now evenly split with four liberals and four conservative justices. garland could tilt the court to the left for the first time in decades, though some on the left are concerned that his record on progressive issues is unclear. we'll have more on the supreme court nomination after headlines. in news from the campaign trail, republic

good to see you. >> reporter: hi, amy. >> amy: talk about the polls. we're pufting a lot of emphasis here in florida. he was within eight percentage points of donald trump and now it's not even close. >> reporter: i would put the caveat on it that it's one poll. but the average of polls show not great things for marco rubio in florida ahead of tuesday. the other thing to watch, on the election days, the numbers have shifted pretty dramatically. so you don't know until the day happens. look at what happened in michigan. bernie sanders was down 20 points to hillary clinton the day before heading into michigan and ended up pulling out a victory. that's the only caveat. i say it does not look great for the marco rubio team heading into tomorrow. >> you heard him say a couple of times that he is not going to rerun for the senate seat. if he doesn't end up winning florida, what happens to rubio. what do the pundits say? >> reporter: i don't know. he obviously would be considered for a ticketer or could be considered for some other position. he's obviously sh

john, amy? >> john: let's get live to holly bristow live at the scene on i-4. >> reporter: a very busy and sad morning here on kirkman and sand lake road. you see one of the lanes, two of the lanes are slow. traffic moving slowly after troopers tell us a wrong-way driver caused a fatality right here on the westbound of i-4. it's unclear where the wrong-way driver got on the interstate. a taxi driver head on, killing both of them. i asked troopers if they know what the cause could have been at this point for the driver going the wrong way. >> we found a bottle of hennessy in the wrong-way driver's front seat. that's typically the number one reason why people drive the wrong way. >> reporter: i talked with kim montez, telling me they are waiting on next of kin on the taxi driver and driver of the green minivan that caused the wreck. troopers tell us they are not sure when the entire westbound lanes will be open. the two closest to the center lane are still closed. one lane is completely open as is

i'm amy goodman. the supreme court has deadlocked four to four in a key case that could have undermined the power of public employee unions to -- effectively dealing a major victory to the unions. following the death of justice antonin scalia last month, the eight-member court split over whether public employee unions can continue to collect mandatory dues from workers who benefit from collective bargaining, even though they decline to join the union. the split leaves in place a lower court ruling allowing unions to continue to collect the fees. it's the clearest example to date of the impact scalia's death has had on the court. he had made it clear during questioning that he sided against the unions. in a rare move that could be aimed at averting another four-four deadlock, the supreme court ordered attorneys in a key birth control case to file new information. the court heard arguments a challenge by religiously affiliated nonprofits to the affordable care act's guaranteed coverage for birth control
