. >> he frequently says, i represent vermont. it's a small rural state. we have no gun laws. here's what i want you to know. most of the guns that are used in crimes and violence and killings in new york come from out of state. and the state that has the highest per capita number of those guns that end up committing crimes in new york come from vermont. >> reporter: the vermont governor who supports secretary clinton actually said that that was incorrect, and the "washington post" giving her three pinocchios today. i'll read you a little of what the post had to say. the difference between this point using per capita calculation and the raw number, one percent of guns with source states identified in 2014 came from vermont, is so stark that it creates a significantly misleading impression to the public. there you have, and erica, this is what happens sometimes when we get into this ugly season of politics, particularly when you're locked in a tight battle, and that is what's happening here in new york. kasie laid out why new york is so critical to senator sanders. the clinton

there are no gun manufacturers in vermont. she's adding two plus two and getting 22. not surprising. but the impetus of the mover for the use of the program is like suing gm because the driver was involved in a dwi. there's no due process, there's no fairness, no connection between the manufactured product and its misuse by an ultimate owner. and in order to prevent people from doing that, congress enacted legislation that said you can't sue the manufacturer for the misuse by the ultimate owner. you could sue the manufacturer if there's a defect in the design, but you can't sue them because somebody committed a crime with it. charles: you mentioned congress, is there anything in the constitution that prohibits a government from making this a law? in other words, if hillary clinton won the white house and democrats swept the house and senate, could she propose legislation that completely reverses that? >> she could propose the legislation, but-- ments -- a judge could not permit the imposition of liability without fault because you have to show fault, something that th

she was implicitly suggesting vermont and senator sanders, the senator from vermont, were to blame. was that's a mistake? >> no, no, no, actually, i think what she was saying is that we need national gun control activity and action by congress, in order to address a problem that results in states like new york being hurt by the fact that we have other states such as pennsylvania and vermont and states in the deep south that have lax laws. the majority of weapons that are used for instance, wolf, to commit crimes on the south side of chicago come from the neighboring states of indiana and wisconsin. in south central los angeles, things have gotten a lot better because the overwhelming majority of guns in l.a. actually come from the neighboring state of arizona. and so we've got gun violence problems all across inner city america, including here in new york city and many neighborhoods that i represent. senator sanders on issue after issue has consistently opposed a national solution voting five times against background checks, voting twice against holding gun manufacturers liable for
