rights and so george mason refuses to sign. jerry was sign of sort of an iconoclast and hard to pin down what he actually believed about anything, but it's true at the convention that some of the things he complains about he worried about the power that was given to the sovereign states about slavery and he worried about national power. the three of them refused to sign. edmund randolph was back to virginia and pretty soon decides that he's for the constitution so he really went back and forth a lot. in all of your research, who is your favorite character? >> guest: my favorite, in terms terms of a character you'd always pick ben franklin because he had more one-liners than anybody else. i think for myself out of this book, governor morris came across as the most interesting. he's the the only person at the convention who speaks passionately about slavery, there are speeches that madison records in which morris basically says we are going to have a divide between the north and the south over the slavery issue. he's quite remark

anti-federalists like george mason from virginia, who had written the virginia declaration of rights that was the most important source of jefferson's declaration of independence, had initially supported the constitution, but became concerned because it didn't include a declaration of rights, the government might menace the natural rights it was created to protect. so mason and two others, gary of massachusetts, and edmund randolph, refused to sign the constitution because it didn't contain a bill of right. james madison initially denied the need for a bill of rights on two grounds. he said it could be unnecessary or dangerous. unnecessary because the constitution itself was a bill of rights by constraining congress and only granting it enumerated powers, it insures government couldn't threaten liberty, but he also worried it wasn't necessary because if you wrote down certain rights, people in the future might assume if the right wasn't written down, it wasn't protected. that's why he initially said no. based on the opposition of the anti-federalists, people in the states who read co

they wanted to get out of there when george mason said, we have no bill of rights. they said we do not need it because the states have their own presentations and they have bills of rights and we're not taking it right away. so the dismissive. three members of because additional convention did not sign the constitution because it did not have a bill of rights. subsequently, james madison recognized he had made a mistake probably not supporting the bill of rights and ultimately in the got becausess, he dental congress to read a bill of rights. but when it went to the states it was 12.n, there were 200 proposed amendments to the constitution in the ratification process, it is still them down and ultimately they had about 17. then they met with the senate, the senate have 12. they compromise to 12. 12 when to the states and 10 ratified. interestingly, the first amendment was not a first amendment that. the first amendment was an amendment that actually would expand to members of congress. we would have more members depending on the population. that got voted down becau

they refused george mason and others to add a bill of rights. they said we do not need one. it could be difficult. it was a hot and muggy summer in philadelphia and they just wanted to go home. and there was an article complaint to the people who became the opponents of the new constitution that it was anti-federalist, because they can go around the country and say, look, these people write the constitution, but they do not provide for our rights. well, james madison and the other federalists got the point. he was reluctant to have a bill of rights. but he said, i get it. we well added and just ratify the cause to shen and the first congress would propose amendments to create a bill of rights, so that is what they did, of course, and madison was as good as his word, and the bill of rights came to being. so basically, what do we have in this story? we have the a story that is part innovation. federalism was very american. on the other hand, you have got the tradition of the magna carta and its teachings, in particular in the state and federal bills of rights, so how would i s
