jim, back to you. >> dann cuellar thank you. >>> a man who claims that he was victim number two who was seen being abused by jerry sandusky in a locker room shower testified for the first time today. sandusky is trying to get his conviction overturned. action news reporter chad pradelli has the story from belfont, pennsylvania. >> reporter: appellate attorneys for jerry sandusky called victim number two to the stand this afternoon. during a contentious exchange the man testified he was the boy whom former penn state coach mike mcquery claims he saw being sexually abused in a football facility in 2001. victim number two testified initially he told prosecutors and then defense attorney joe amendola that he had never been abused by the iconic coach. during the criminal trial victim number two was a defense witness that's until he changed his story and said he too was a victim. he eventually received a settlement from penn state. and appellate attorneys believe prosecutors hid information that didn't help their case. prosecutors have said they didn't believe the man was credible and definit

"action news" reporter dann cuellar is live at the scene. dann. >> reporter: that's right jim we just got word a few minutes ago from police unfortunately that the little girl died from her injuries over at children's hospital. meanwhile philadelphia police continue to search for the hit-and-run driver who has yet to be identified tonight. police say it was about 3:16 this afternoon that the eight-year-old little girl was walking home from school with her friends and struck by a man headed south on 63rd street. witnesses say the little girl was thrown about 90 feet from the point of impact. witnesses tell us they heard a loud boom and went outside to see what happened. >> i was in the kitchen. then i heard a bunch of people screaming and hollering so i came outside put something in the trash and then that's when i saw a line of ambulances and people were crying and stuff and then i saw somebody getting in an ambulance and i saw a little book bag so i figured it was a child. >> reporter: police say the driver of a gray or silver nissan altima
