pamela brown, our justice correspondent is with us. i know you've gone through this decision. >> 29 pages worth and what you said, you'll remember the compromise that the government presented to the justices perhaps had the temporary restraining order applied to people who have already been here to the united states who have a reason to be here, who have valid visionas and have the ban for people who have never stepped foot in the united states. but clearly the justices or the judges i should say in the ninth circuit court of appeals have rejected that and said that the temporary restraining order should stay as is, what judge robart ruled in washington state. and they basically said there was a big difference between the state's case and the government's case and i think this quote really sums it up in terms of how they looked at the government's argument. they said we hold that the government has not shown a likelihood of success on the merits of appeal nor to enter a stay would cause injury, we de-d.o.a. deny the motion for a stay.
