big news for bart. state regulators just approved a 10-car fleet that's part of the fleet of the future. but this comes after a series of setbacks in recent months. the entire 60 car fleet was supposed to start running in 2016. then because of delivery delays, bart reduced the number of cars set to 40 then 10. they failed to pass testing. they had hardware issues including the fact that some train doors weren't opening. now the california public utilities commission says the 10-car train passed the teslas week and it can start carrying passengers. >> we have been using these trains since like 1980s or something. an upgrade would be good. but not if it means higher fares. >> reporter: it's unclear when 50 more cars will be delivered and tested but bart says the entire project is set to cost about $2.5 billion. a few months ago when the initial testing was happening for this 10-car fleet bart said that as soon as it's approved, they will start running the cars. now, they haven't set exact launch dates yet

( marty ) a stanislaus county animal shelter is conducting more sweeps to round up stray dogs. one month after a 56-year old woman was mauled to death in modesto. during a sweep this week, the shelter found 30 dogs in just three hours. they rounded up huskies, pit bulls, and other mixed breed dogs. and this is adding to an already overcrowded shelter. the director of stanislaus county animal services, says dogs are double bunking and the staff is working overtime.

this is a bart officer. you know what, we do know and again, this is very early in the investigation, what we do know is that a bart officer was at this location 7th and chester. there were two individuals. the bart officer who was dressed in full police uniform did discharge his firearm. we have two adult males that were taken to the hospital. i know there's going to be a lot of questions about, was any of the individuals struck? we can share with you that we do know both individuals had gunshot wounds but we cannot confirm that this was from the discharge of the bart officer's firearm. i'm going to share with you the reason why. the reason why is because we recovered a firearm from the scene. so let me go over this again with you. 4:41 p.m., the oakland police department was requested to assist bart with an officer- involved shooting. our oakland police officers arrived at 7th and chester. when officers arrived they learned that a bart officer dressed in full police uniform had discharged his firearm. ther

bart police officers shooting two people across from the west oakland bart station. betty yu on the scene. what are you learning? >> reporter: allen, i heard from the oakland police department minutes ago and we learned that two adult men were shot and one bart officer did open fire near the west open bart station. take a look at video up above all around the station. there is a lot of police activity as investigators continue to find out what happened at 4: 40:00 p.m. this all went down on seventh street and chester street. that's right across the street from the bart station. now we know from the oakland police department that two men were found with gunshot wounds and again one officer, bart police officer did open fire. unclear at this time if those gunshot victims were first by that police officer. this is a what they are trying to figure out in their investigation right now. take a listen. >> the bart officer should be either at our police department, we are going to want to speak with the officer but i just came from the scene. so we will certainly follow up.

a lot of opposition this morning against a new parking plan at bart stations. the idea is to ease congestion by charging more during peak hours. kpix 5's jessica flores has more on the push to free up parking spaces. jessica. >>> reporter: good morning. we are at the fremont station. right now you can see behind me parking is pretty light right now. there's not a lot of people here. that's because it's 5 a.m. but even before 7 a.m., you will see a lot of people circling around the bart station looking for parking. it becomes really packed. and the list to get the reserved parking spaces is really long. so bart board of directors is trying variable pricing one idea they are exploring. the more demand the higher the price. that means during peak hours, like the morning commute, riders would see higher station parking fees and lower prices at off-peak times. the current parking pay machines can only charge a single rate so a variable pricing structure would have to come with equipment upgrades. one idea is to use automated license plate readers to charge for parki

board member thrilled that the first new bart cars will begin carrying riders tomorrow and bart tweeting, we have been given the go-ahead. in a letter obtained by "2 investigates," the california public utilities commission confirmed bart successfully passed a test run of the new cars january 9th. this comes after first failing that teslas november missing their thanksgiving deadline that had already been repeatedly delayed. this rider has been following the saga. in 2012, bart signed a $2.5 billion deal with canadian manufacturer bombardier after which "2 investigates" exposed a list of delivery delays and problems with thmaker one that contributed to bart crashing a pilot car in 2016. even though riders are getting 10 new trains friday, according to the original contract, by this time, the bay area was supposed to have 230. >> it feels kind of funny being in the tech hub of the world and we have this kind of, like, archaic, um, transportation system. >> reporter: with 10 cars now and the hope for 775 new trains by 2023, bart riders say they are excited but not confident. >> bart is suc

this shooting involved a bart police officer who was on duty at the west oakland bart station across the street from us. that officer saw two men struggling with one another here in front of this barber shop and restaurant across the street. according to investigators one of the two men was holding a gun. that police officer shot and killed that man. the other men involved in the initial dispute also ended up getting shot and wounded. this all happened yesterday at 4:30 in the afternoon outside of the uppercuts barber shop on seventh street. this is just across the street from the west oakland bart station. we have not received the identities of either of the two men over shot yesterday. also we do not know the identity of the officer involved. we did talk with a woman in the area at the time and she says she witnessed the initial argument which may have started inside the restaurant here and she saw the bart police officer respond. >> i heard the dispute and when he got shot they came running across the street.>> reporter: the police department for bart is conducting its own investi

certainly a big day for bart. with he know there have been quite a few delays in getting the new train cars into service. but the day is finally here. bart riders will be able to hop on board the fleet of the future. the inaugural ride will happen an hour and a half from now and will be leaving the macarthur bart station in oakland. bart rolling out a ten-car train that will be carrying passengers for the very first time. originally bart had plan today roll out the new train cars last november but there were delays. the train cars failed an important safety test. so those problems had to be fixed before the cars could be put into service. finally this past wednesday, bart got the green light from the california public utilities commission to put the new cars into service. and this morning, a lot of bart riders are buzzing about the new train cars. >> it's nice. it's super. it's deluxe. it's in the future. i like it. >> actually i thought it was -- came out sooner than i thought. i thought there would be more probl

bart is all back on schedule now. the first trains out of the gates this morning, they were moving slowly just to be on the safe side. this is something that is standard procedure, any time there is an earthquake, this is done out of an abundance of caution, they were out inspecting the car tracks this morning, following the quake, inspectors didn't find damage at that time. the first trains that left this morning on each individual line, they traveled at a reduced speed, that's so the operator on board those bart trains could keep an eye out and check for anything that seemed unusual along those tracks and the operators did not find any damage or anything that seemed out of place and so because of those inspectses and because the trains were moving slowly this morning, therein eggsly was a 20-minute delay systemwide. but, things are back on track. >> i haven't looked at the news or checked what's going on. >> things are running slow. >> okay. >> they're making sure the tracks are safe. they look okay. >> that's good
