we want to go back it matt keller for the latest on the crash in communications hill. matt? >> reporter: good morning, jessica and reggie. we got an update from the san jose police department and they confirmed that two people did die in this crash here on casselin o drive in san jose. you can see that tow truck drivers are on the scene. they pulled the car up from the hillside and are now sweeping off the debris. we also heard from san jose police that alcohol and marijuana are suspected to be a factor in this crash. here's video from earlier this morning. san jose police say a honda accord was headed eastbound on casselino drive. it was a violent crash that the en jing separated from the car. the adult male driver and female passenger died at the scene. another female passenger was taken to the hospital with life-threatening injuries. another man was taken to the hospital with nonlife-threatening injuries. their identities are not being released at the time. two dogs were inside the car at the time of the crash. one dog did die at the scene and we assume as soon as the tow

abc 7 news reporter matt keller live for us in san jose. matt? >> reporter: good morning, natasha and reggie. santa clara county leaders have been concerned about this question being added to the 2020 census. now that it's official state leaders are stepping up and filing a lawsuit against the trump administration to stop it from happening. the commerce department made the announcement last night it was adding the citizenship question to the 2020 census. officials say the data will help the justice department enforce the voting rights act which protects minority voting rights. opponents say the question will discourage immigrants from responding and cause a population under count. california attorney general javier becerra says the citizenship question is unconstitutional and would violate federal statutes. santa clara county leaders were so concerned about a potential citizenship question they filed the freedom of information act requested in february. for more information how they plan to protect the privacy of the respondents. the census deter

matt keller is live in the mission district this morning. matt? >> reporter: good morning, reggie. stran police still have the crime scene tape up blocking it off on 21st street, you can see that the crime scene unit is. behind that, there's a spotlight on the scene of this officer involved shooting while they continue their investigation this morning. a neighbor told us what he heard and saw last night. >> i've heard gunshots before in the neighborhood. i can't imagine it was less than 20. it was like it lasted for i while and it was -- then i came out to see what was going on. >> this is what he saw at about 10:45 last night. a huge police presence. officers were flagged down in their patrol cars by two armed robbery victims. they told officers the suspects were driving a black honda civic. the officers spotted that car on capp street between 21st and 22nd streets and ordered the suspects out of the car. the driver was detained. they noticed the trunk was open and saw a secretaond suspect in trunk. the suspect in the trunk died at the scene. officers found a handgun in the trunk.

abc7 news reporter matt keller is live in san jose with the latest. >> reporter: the last time the citizenship question was asked for a census was back in 1950. but it's back and the state is trying to stop it. the u.s. census is filled with a lot of questions, but a new one about citizenship status just announced by the commerce department for 2020 is sparking a lot of controversy. the department said the information would help the justice department enforce the voting rights act, which protects minority voting rights. in the announcement, the commerce department said secretary wilbur ross determined obtaining complete and accurate information to meet this legitimate government purpose outweighed the limited potential adverse impacts. in february, santa clara county leaders knew the citizenship question was a possibility and filed the freedom of information act request to find out how the u.s. census bureau would plan to protect the privacy of respondents. >> the real question is, are we asking that question because we want to separate people? are we asking that question because we want to in

abc 7 matt keller is live in mountain view for the latest, matt? >> reporter: chp is not commenting on their ongoing investigation. however, tesla is speaking out about what they say they know about the crash. the crash in mountain view friday, horrific, 38-year-old was killed after his tesla model x crashed into the divider. the question everyone is requesting, was the model x using auto pilot at the time of the crash? in a new blog post titled what we know about last week's accident, tesla wrote they have yet to retrieve the vehicle's logs so they do not know what happened in the moments leading up to the crash. the ntsb is investigating if the car's auto pilot system was activated at the time. tesla says data shows vehicle owners driven that same stretch of highway with auto pilot engaged 85,000 times since 2015 and 20,000 times since the beginning of the year. the blog postfocused much of the attention on the severity of the crash. tesla blames a missing crash. these are from a driver who commutes daily. one image shows what the safety barrier

let's get to matt keller. matt? >> reporter: good morning. a very active scene here on communications hill in san jose and a devastating crash. my photographer is zooming in here. we got this vehicle parked in front of us. it just moved there. the san jose police department just moved it there. they're blocking the scene, the cars to the right of the vehicle and the injured is in the middle of the street here. it shows you how devastating this crash was early this morning. we're working to get information confirmed by san jose police. we saw a yellow tarp over the vehicle which usually indicates it's a fatal crash. this happened after 1:30 this morning. this happened at cass lino and manuel street. a big response from san jose fire. you can expect this street to be closed for a while between kbhun indications hill boulevard and manuel street. san jose fire is coming back to the scene. obviously, there's something that the san jose police department needs their assistance with, a lot of times that's extrications. we'll let you know this mornin

matt keller is live with the hall of justice in san jose. matt? >> reporter: kristen, wrapped up here santa clara courthouse. denied a reduction in the $210,000 bail, so he's going to remain in the santa clara county jail for now. we just took video in the past hour here inside the courthouse. this is the suspect. he's 21-year-old louis. a fourth year student studying chemical engineering at san jose state. they were called to a disturbance at campus village a on march 3rd. officers say the alleged victim and other state student left the scene but eventually talked to him. since then, two more alleged victims, both male san jose state students have come forward. one claiming an incident happened in 2014. march 5th and all three crimes on campus and all three, alleged alcohol was involved in the cases. faces five charges related to sexual assault. university police are saying this appears to be a pattern, so they are emphasizing with the media that they wnt to get this information out, so they can find out if there are any other alleged victims out

matt keller is live in palo alto. matt? >> reporter: natasha, what a horrible crime. a high schooler out for a jog on this path when a man pulled a gun, pointed it at her head, pulled her off the path and sexually assaulted her. he still hasn't been caught. this happened in broad daylight around 1:45 yesterday afternoon. this is a trail along deer creek road near tesla headquarters in palo alto. a passerby called 9-1-1 after the teen flagged them down. police searched the area for two hours but couldn't find him. he was wearing a black sweatshirt with a bear logo on it. he's about in his 30s. they're asking you to keep your eyes out for anyone acting suspiciously. >> we're following up on leads and asking if anyone has any information whatsoever, or if anyone saw somebody lurking in the bushes in that area at any point, please call us on 911 right away. >> reporter: the girl was treated at a local hospital. police say she's in stable physical condition. it's unknown if she'll be able to help detectives make a sketch of the suspect. they're going to increase patrols in

. >> reporter matt keller is live in the district this morning. matt? >> reporter: good morning, reggie. i want to give you an idea of what's taking place behind me. we're between 21st and 22nd street on capp street. the crime scene is parked and behind it are big lights that's showing what is happening down on the ground as officers continue their investigation. this took place last night after 10:30. here's what happened, the police say. officers were flagged down at 20th and capp street by armed robbery victims. they gave officers descriptions of the suspects and told them they were driving a black honda civic. the officers spotted the car between 21st and 22nd streets and ordered the suspects out of car. the driver was detained, the officers then noticed the trunk of the civic was open and saw a second suspect in the trunk. while trying to detain the suspect, an officer involved shooting took place. here's what a neighbor, who did not want to be identified, heard. >> then i heard a shot. and then two i -- definitely heard a shot. then i heard like -

matt keller live for us in mountain view with the details. good morning. matt. >> reporter: natasha, tesla is extending deepest sympathies to the family and friends to the victims in the crash. the man killed last friday. they're offering up their assistance to authorities in this investigation. tesla received a new blog post offering new insights into this crash. they say one of the reasons the crash was so severe is the safety barrier known as a crash attenuator was not there when the crash happened. they say this image shows what the barrier on southbound 101 at the 85 carpool flyover in mountain view looked like when it was in proper condition and then this is what it looked like the day prior to the crash. they say these pictures come from witnesses of the crash that commute daily past this location. tesla believes it was removed or crushed in a prior crash without being replaced. tesla says they've never seen this level of damage to a model x in any other crash. the driver, 38-year-old, he was killed. ntsb investigators want to know if the autopilot
