in the stormy daniels affair? >> well, i think it could be, because not only does it affect the enforceability of the contract, but it also suggests that michael cohen might have done some things that are unethical. it is a lawyer's duty to keep a client reasonably apprised of all matters. it is a lawyer's duty to discuss settlements with their clients and not to enter into settlements unless they're so authorized by their client. so these statements could also get michael cohen into some ethical trouble with the state bar of new york. >> phil rucker, in the good old days, when the white house and campaigns had messages of the day, you wouldn't have made unethical actions the message. but if you look at the day in total, between scott pruitt's antics, between barbara's assessment of michael cohen's conduct as a lawyer, unethical seems to be a pretty good way to wrap up the day. what story -- what part of this story do you think irks the president the most? >> it's probably a few things. i think he's feeling a lot

now, we know that stormy daniels' team wants to go and a quick trial. they want a deposition and move forward with the litigation and the federal judge is saying wait a minute something has to be decided. i have to make a decision about whether this matter will be referred to private arbitration. i'll i'm not allowing to you start discovery. i'm not going to set a trial date because a fundamental question has to be answered as to the validity of this arbitration agreement. rook, when they remove this matter, cohen's team from the state to the federal court they did so for this reason. they knew that federal judges are no nonsense, play by the rules and a federal judge doesn't like the fact that stormy daniels' attorney didn't make himself available for what's called meet and confer. they want lawyers to work out these things like extensions. they don't want you running into court every time, you know, there is a request, particularly a request like this for a simple extension of time to respond to a complaint. so the judge wasn't too happy with stormy d

joining me is daniel goldman, former assistant u.s. attorney for the aforementioned southern district of new york. daniel, let's start with taking the fifth before we get to the image of the president on the floor in the residence of the white house going through sealed boxes that say federal evidence. we all learned in civics that it doesn't imply guilt. so what does it mean in this case? >> well, the sort of bare case that it doesn't mean that much is that following the searches and the revelation that there is an intensive investigation of michael cohen, any defense lawyer who represents michael cohen would say i'm not going to have this guy under oath, even if he's innocent, because somebody else thinks he's committing crimes. so anything he says could be used by them and therefore could be incriminating. but it's not, as michael avenatti said, necessarily an admission that if i speak under oath i could be incriminating myself. that's not what the fifth amendment is and that's not what he's doing by asserting the fifth amendment. >

he actually does have some real lawyers on the stormy daniels scandal. he has michael cohen but he has additional lawyers working with him on the scandals where these women have been supposedly paid off. that's where he lawyered up. maybe the president saw this before we did in terms of the legal jeopardy he's in here. >> and moving today's case to the south everyone district of new york is fascinating because as you know they do not have a confirmed u.s. attorney working there. the u.s. attorney who's in place there, temporarily, his appointment is a 120-day appointment that runs out on may 5th. so the president doesn't have a prosecutor there to fire and replace because the next -- the people who replace this one are the judges who run the district. they get to decide, because the president hasn't chosen anyone. >> the mueller investigation has taken some interesting turns. one of them was to spread a little bit of the work around. we had the filing from mueller last week that said when we charged manafort we had the national security division of the j
