senator reid did it in 2013. senator mcconnell in 2017. it's a lot like the referee looking at the rule book and saying, a first down is ten yards, but i'm going to call it nine. he's the referee so it's nine yards. should we do it? no, we shouldn't. we should change it by a majority. bipartisan majority and should do it now. senator levin said, when a senate majority can change the rules at anytime, and president jefferson says it doesn't matter what your rules are, you need rules. it's an awkward position for the chief rule making body to be not following its own written rules and expecting the rest of the country to do it. but what should we do? what we should do what the senate did in 1995, with the hutchinson precedent. the senate came back and changed it by more than 60 votes. we should do what we did in 2011, 12, 13. when i a republican volunteered to help president obama, a democrat and democratic majority to make it easier for presidents to confirm nominees and unlike what the ranking member said, we did it immediately. i didn't s

these are senators who today would be among the most conservative members of the senate. they are at her critics of the war in court and the warren court's key decisions. so essentially what they decide among themselves and eastland is whochair of the committee controls how the process operates. thanks to the examples of the last few weeks the key person in the kavanaugh hearings was chuck grassley. what eastland mcclellan and ervin decide is that they are going to use this opportunity to put the warren court on trial. to basically bring in fortis before the committee and grill warren courtety of decisions. so instead of a routine hearing, what fortis gets is very detailed questions about specific warren court decisions. he doesn't give consistent answers. sometimes he says he will defend these decisions. sometimes he says he can't talk about them because he's a justice and can't talk about how the court made its decision. the committee also starts asking questions about fortis's advice to johnson. highly improper. the supreme court justice should not be providing politic

senator graham has represented south carolina in the u.s. senate since 2002. prior to serving in the senate, he was elected to the u.s. house of representatives in 1994. the first republican from the third congressional district of south carolina in over 100 years. before his election to congress, he served as a judge advocate general in the u.s. air force and later in the south carolina air national guard and air force reserves. just weeks ago, senator graham was elected as chairman of the senate judiciary committee, a committee with broad legislative jurisdiction and oversight of the departments of justice and homeland security. the judiciary committee is, of course, tasked with a consideration of all article three judicial nominations including nominees to the supreme court. the senate judiciary committee managed a historically blistering pace in confirmations over the past on it for months under senator grassley. senator graham inherits a fair amount of moment to him in that part of the committee's work. senator graham has pledged the confirmation of judge

i share senator durbin and senator whitehouse's views about mr. barr's family, about his clear respect for the justice department as an institution, most of his family members went on to work in the justice department and agree with sheldon whitehouse that some of the things that he said about respecting mr. mueller and the continuation of that investigation were positive moments in the hearing, but we cannot simply view this nomination in a vacuum. we have to look at the context in which he is nominated and we also have to look at the context of the time that we are in. the nomination comes at a time when there are investigations by a special counsel and multiple u.s. attorneys offices over which mr. barr would oversee in to the president of the united states and his associates that involve campaign finance violations and an attempt by a foreign adversary to interfere in our elections, for starters, and when i referred to the president of the united states, i mean the campaign which he was part of, and also some of the individual matters that wer

head of the senate republicans, everett dirksen. republican senator from illinois. he and johnson had worked closely on the civil rights act. he was a supporter of african-american civil rights. he knows fortas and likes him. he also knows and likes thornberry. dirksen commits to supporting him. johnson also reaches out to mike mansfield, the majority leader of the senate, representing some liberal moderate democrats. mansfield isn't thrilled about fortas's nominee but will go along. in late june of 1968 it looks as if this is a done deal. fortas has been nominated, thornberry is the associate. the three most powerful members of the senate johnson believes are already on board is willing to support the confirmations and this is a done deal. johnson's problem is that he essentially lost a decent amount of power. he hasn't conceptualized that and he will learn it very quickly in the summer of 1968. two things happen almost immediately. the first, 19 republican senators signed on to a public statement prepared by this man, robert griffin, a republican senator from mich
