i want andrew mccabe to know this. oh, yeah, the lawyer for stormy daniels, i gave him the benefit of the doubt. we live in a country where accusations against anybody, even from the doj inspector general and former colleagues of the fbi, yeah, they are incredibly damning, aren't they? but everybody deserves the presumption of innocence. innocent until proven guilty in a court of law, and by the way, i will not deviate from that. it looks bad. it looks like mccabe will face just as very soon. no one has to wonder if he's feeling differently tonight about his treatment and jim comey's treatment of a 33-year veteran. here with me tonight, fox news contributor sara carter. you know, i look at this, i read the original report, and i thought, why did it take this long? if you don't tell the truth, look what happened to all the other people on the other side of this thing when there was no russia collusion. >> remember, sean, this is part of a much bigger investigation. what we are looking at here is the u.s. attorney jesse

let's start with the mccabe. your thoughts. >> i think his lawyers made an attempt to get the case killed. obviously, the u.s. attorney in the district of columbia thought there was a case that should be brought. his lawyers disagreed. they took it up to the deputy attorney general under what was basically an internal appeal. the deputy attorney general in contemplation with his team reviewed it and sent it back saying no, we don't think that you are correct off of mccabe's lawyers. in fact, the u.s. attorney now can proceed with bringing a case. it will go to the grand jury, the grand jury will then hear the evidence and in all probability issue an indictment. that is what happens. it's not just one count with the mccabe. it's at least three, according to the report that was issued. let me tell you this, they call it lack of candor, but in indictment, it is called a 1,001 violation. it's perjury. that's what this allegation is. i want to be clear on this. i think this is just the beginning of the problem for the

now the mccabe story is complicated by several fact kwors. the first being that that disclosure in question was something he claims he was authorized to do by virtue of his position as deputy director of the fbi. the second complicating factor being that he shared information with "the wall street journal" that was unfavorable to hillary clinton, not donald trump. and what's not in dispute is donald trump's clearly stated and well-documented desire to prosecute his political enemies. it's unlikely that mccabe would face any significant jail time. he has no prior criminal history. he would be dharjd under 18 u.s. code 1001 with making false statements to the government and he would likely fall within this recommended sentencing range of 0 to 6 months, which would permit him to ultimately spend no time to federal prison. >> you have mccabe currently suing the trump administration, right? he says that he was fired, as you know, for essentially retaliating -- the trump administration retaliated against him for his role in the justice department's investigation, as julia talked about, between the trump campaign and russia and potential collusion here. what does this mean for that lawsuit, if anything? >> reporter: they'll proceed on two parallel tracks. the civil lawsuits is in essence mccabe's effort to claim the pension that he worked for so many years to earn, claiming that he was fired in an inappropriate manner without cause too close to that date. and if you'll recall, those circumstances were really pretty unusual with a late friday evening firing by then at

the doj rejected a last-minute appeal from mccabe's legal team. president trump's attorney, jay sekulow, says he thinks the worst is yet to come. >> its perjury. that's what this allegation is. i want to be clear on this. i think this is just the beginning of

mccabe said he wanted to set the record straight. he felt the newspaper had reroan yo -- erroneous information. he reached out. the inspector general launches an investigation into contacts. he gets swirled up in this investigation. they ask him questions about his contacts with media and they say the inspector general that he lied to them. he wasn't candid about those conversations and so as a result of that, they recommended charges be brought against him for lying to these internal federal investigators and that is where we are now. we are waiting to hear if the department of justice is going to file those charges. there seems to be indications they are because they said we're not going to listen to this appeal. we're not going to let you win on this side. we're going to go ahead and pursue this on our own and therefore not allowing mccabe and his lawyers to appeal anything the department of justice was doing. >> how unusual would it be to see an indictment in a case like this for lying to the inspector general over the department
