police are enforcing their no eating policy at bart stations and on trains. you might remember the man who was cited for eating a breakfast sandwich at a bart station back in november. steve foster of concord. this is a picture of him. he was furious. when the act of simply eating his breakfast landed him in handcuffs last month. so we sent bart a public records request to find out how often that happens, and we just got these documents back. as it turns out, bart's own records show that over the past six years, it has cited a total of 44 people, for breaking the no eating, no drinking rule, less than one per month. and of those cited, 60% were black, 26% were hispanic or another ethnicity, and 14% were white. our investigative unit just finished an incredible series that takes an in depth look at what happens on bart. we spent months riding trains, recording what we saw, and you can watch the entire series on our web site, nbc bay area.com/derailed. >>> the city of martinez lost a fixture on friday, one that goes back more than 160 years. yesterday marked th

bart: it's not always free of bias. and then the responses that people have are also not gonna be free of bias but i think the thing we have to realize is that the internet tips the scales. whereas, you're approaching an audience that i would call, sort of a bell curve of political views, and you would say, "this is kind of the moderate view and these are the extremes." the internet flips that on its head and it basically says, "the extremes, the loudest people in the room, can very easily get the most attention." and as a result, we need a different sort of code of conduct for handling that. like, we--our social contract, as society, as civilization, was not built around letting crazy people talk. it was letting people who care about their communities come together and share reasonable ideas together in a reasonable way. the internet fundamentally has tipped that and, early on, it was amazing, we had these free environments. we didn't think that was gonna happen. scott: our favorite high tech authors of the year when "

so bart is trying to crack down on them. in the past, what they've done is sweeps where they've gone and checked for tickets. and if you don't have one, you're subject to a $75 fine. well, there is some questions raised about that. one of them is whether or not they were being profiled or not, whether they were fair. it turned out of the more than 12,000 tickets that were given out over a year period, almost half went to african americans. but still, they said look, we targeted everybody. we set up a line and target everybody, kind of like a dui checkpoint. but nonetheless, i think the results were disturbing to some people. bart started something else in setember, going down and going through each train individually. but this time rather than handing out citations which would criminalize the behavior and subject you t a fine that. >> just said beat it. get off the train. get out of the station. you get a pass. just go. you didn't have your ticket. okay. we're going give you a pass on the fine, but get out of the station. an
