manchin may be the outlier here. he is also the one that's being the most closely watched for a potential acquittal of the president. a lot of democratic sources i've talked to feel doug jones, who is up for re-election in alabama, while he is up for election in a red state, he needs the democratic base to turn out for him if he has any hope of keeping his seat. and that, you know, voting to acquit the president is not part of that strategy. so everyone is probably watching manchin morthan doug jones right now. >> not unlike the president's strategy which is a base mobilization strategy. thanks very much. >>> with us now is senator mazie hirono of hawaii. have you submitted questions and, if so, >> we've all submitted questions. my questions will go to focusing us on exactly what the president did and also some of the arguments that the president's team has made. for example, is it exonerating that the president said no quid pro quo after the fact? so those are the kind of questions that i would -- i have submitted.

he said you've got a number of democrats, joe manchin, doug jones in alabama, who have made some temperate comments about voting for acquittal. restrained comments. he said you have camel here is she's going to vote -- you have kamala harris. she's going to vote to remove the president. talking about comments that joe manchin told another network at one point and i think it weighs on everybody. i am very much torn by this. they are being very careful. are you going to leave it up to your constituents, the american people? or are you going to take it in your own hands? >> harris: i think being careful is what they are supposed to be. there was going to be a penalty if you speak up and now we have some people not even paying attention. the whole trial is going on. some senators being accused of snoozing or playing with toys or whatever. >> chris: they don't like to pay attention. >> harris: there was going to be punishment for speaking up so this is the opposite of what we are actually seeing. i don't trust what people say until they actually take a vote. >> marie: i totally agree with that.

and joe manchin has done this before. this does break the dam of messaging on the democratic side that hunter biden or joe biden for that matter shouldn't be part of the conversation. my real question here, actually, is how is this going to impact the republican deliberations here. because you have to understand, i was listening to joe earlier in the program. my sense is he's right and our reporting says he's right that mitch mcconnell has more control over this situation than some of the headlines late last night suggested. yes, he acknowledged that right now there are still enough undecided republicans that they're not sure how this is going to break. but you have to understand that there's more than two factions inside the republican conference, and they're at odds. and one of the factions is conservatives like think about josh holly from missouri, ted cruz has been willing to say this in front of microphones. people who are staunch and aggressive defenders of the president and who want to call hunter biden, bring him

>> thank you, vice chair manchin, for that question. it's a vexing policy challenge. because we don't want to trespass upon the first amendment certainly. that is one of the things that makes america great. and we would never attenuate freedom of speech. so how do we do this? there are several things that we can and should be doing and i had the privilege of participating in a meeting with leading social media companies, together with the agls, hosted in new york by the agl, and i was part of that meeting. first of all, anti-semitic speech very often violates the terms of use of these sites and platforms. so we should be encouraging, not censorship, but these platforms, to enforce their own terms. why wouldn't they? they are terms of use. well, they should enforce the terms of use it. is not the government doing it. it's them doing it. and they claim they are doing it. so we should work with them to help them do that. second of all, exposure. we have got to expose this very nom, especially what's being trafficked in the dark web. americans have no idea what's going on

i think they made that case for us yesterday. >> it's something senator manchin one of the swing votes on the democratic side said, which was he thought they made a strong argument, but it also made him want to hear from people like mick mulvaney or john bolton. >> i think there were several things that happened in that trial or the hearings that made it so that republicans felt they can't move over. if you notice, the entire democrat strategy hinted on getting republicans to go over and vote with democrats. but there are several arguments. one is they're trying to remove the president off the ballot nine months away from an election. the other one is getting offended by comments that were made by colleagues and other members of congress, so nadler offended a lot of the swing republicans that they're trying to shift over, get over. shift offended some of the senators that they're trying to get over also. so it's not working. it's not moving anybody. as a matter of fact, to get all of these criticisms by another member of congress has actually moved them in the other direction, i this i

crimes have never been the standard which i think senator manchin sat in his question, they've never been the standard both b before 1998 nor afafter. the second part of your question had to do with the role of the chief justice. i argued 41 cases before our chief justice. he is far more conservative than i am, but he is always fair. i disagree with some of the rulings, but they are best -- based onon a sense o of law and justice and i think americacans should be glad he is presiding over this trial. representative, shifted something which i have been expecting for a while, which is to say, look, we think this whole witness question should be decided by the chief justicice. as i wrote about it in "the new york times," i think there is an easy case the chief justice can decide whether or not witnesses can be subpoenaed. there's a harder question about whether it requires 51 senators to overrule him or two thirds of the senate to overrule him. i acknowledge there's a bunch of debate about that,t, but i don't think there is any serious thete in the first instance chief justice can autho
