why is he still not dropping the case against michael flynn? >> i wish i knew the answer to that, liz. he seems bound and determined to take general flynn to a hearing and then to a sentencing but he does not have standing. he is not a party to the case. and he doesn't even have a right to file a brief with the d.c. circuit court of appeals like he did. so that is one of the reasons we have moved to have the mandamus go ahead issued bit circuit court. and lift the stay they put on it when he petitioned and there are many other reasons too. in fact there is not a single case in the country that allows him to do what he is trying to do. every single case requires the government's motion to dismiss be granted completely, with prejudice. elizabeth: okay. the justice department has asked that the case be dismissed. the judge emmet sullivan is saying no to that. what was meant by the statement in the your filing saying, quote, the district court, the judge, emmet sullivan, has hijacked and extend ad criminal prosecution for three months for his own p

and in the general flynn case. to see the appellate court decide to hear a case that should be ended now based in law, based in precedent, there is no precedent for anything that is transpiring now in the flynn case at either the district court level and judge sullivan's court or at the d.c. appellate court. they've lost their minds here! >> yeah. i mean, first flynn was abused and harassed by the justice department, fbi, etc. now he's been abused by the judiciary for months. the writing's on the wall, lou. as you know, i've been calling on the president to pardon general flynn. these judges have it out for general flynn. he needs to be protected from this abuse. it's not only demand emergency action to stop this? because it's flagrantly unlawful, unconstitutional and unprecedented. go to the supreme court and stop it here. why should general flynn be dragged treaded carefully here, and they didn't take the aggressive steps initially. for instance, sidney powell had to file the motion, the mandamus petition. lou: r

michael flynn's sentencing didn't happen. there was a number of iterations to sentence flynn. flynn requested to withdraw his plea. then the justice department got involved and told the judge that they were going to dismiss the charges. that's when judge sullivan said, no, i'm going to appoint a former judge to argue why they shouldn't dismiss the charges and wanted to have that hearing. flynn's team asked an appeals court to stop that and rule against judge sullivan and strip him of the ability to do that. the panel of judges said okay and agreed with flynn. now what's happening is the full court is willing to hear this. that reset it s the table on th question of whether or not judge sullivan gets to eventually have this hearing. one option that could come back after the full appeals court hears this on august 11th is that they say, okay, fine, you can go ahead with your hearing with this former judge and hear arguments for and against whether or not judge sullivan has to dismiss the case, but here are some parameters in which you need to do that. they could restrain him a l

what are you hearing about flynn? >> yeah, no, i think that that sort of the weather that's floating around washington at this point in time is this is something which may be in the works. i think there are a lot of reasons why one might anticipate that would happen, particularly given what has happened to roger stone. donald trump, you may recall that donald trump as one of the first he had was say he didn't say to james comey go easy on michael flynn. it is documented that he gave false statements to law enforcement individuals. it's different. stone, the evidence is much heavier. there are more charges against stone than there were against flynn, but it is still a case that flynn multiple times admitting having given false statement to multiple investigators. i will say, though, i will be surprised to see him on the campaign trail because all it will do is constantly remind people oh, that's right, you had this national security adviser who had to eleave because he lied to the vice president and admitted having lie

through this abuse of flynn. and it's got to end. it's just got to end. and we have new documents out this showing they knew from the get go he was innocent, yet they continued to pursue him. in fact, they knew he didn't lie, and yet they went to the white house according to the new documents that this justice department was hiding. they knew he didn't lie, and yet they went to the white house, and they lied to pence in saying that flynn lied to him. really terrible stuff. and this doj is awol on investigating any of that. that was criminal activity as far as i'm concerned about. lou: i think, i think most americans absolutely believe that these are criminals, these politically corrupt officials of both the fbi and the justice department and our damned judiciary. i mean, look at this preposterous, these seven justices. they've become a mob on that supreme court. they're outrageous and ignorant, and the american people are, i have to believe, absolutely sickened by it and have had a belly full of it. i can't even

wrongdoing that general flynn had done. so the whole thing stinks to high heaven. it stinks that there was something to influence the 2016 election, and it really stinks if it was after the election that people decided we don't like donald trump, we don't like the result of that election, we're just going to get rid of him. that's an internal coup by the highest levels of the intention community. -- intelligence community. elizabeth: yeah. and james comey testified to congress in the summer of 2017 that there was no active investigation into trump-russia collusion at the fbi. when he left, james clapper indicated the same, that they didn't have the goods. lisa page and peter strzok said the same, but they went ahead with the mueller probe. final word, kt. >> yeah. those guys were going to congress in closed sessions raising their hand, taking an oath saying there was no collusion, there was nothing there. and what did they do after that? they scampered out and went right in front of the cameras and said, oh, collusion, oh, donald trump, he must be a russian agent.
