joining me now, is the president of microsoft brad smith. mr. smith, thanks for joining us. do you see this the way congressman crow does, a modern day pearl harbor? does this need to be a response once it's clear who was behind it? >> well, i do think that those kinds of words are appropriate. this was really an attack of extraordinarily broad cale scale. i think it was a reckless attack because it impacted ultimately around 18,000 institutions around the world. at microsoft, we were fortunate it didn't impact any of our products or services. our products and services weren't used to stage the attack, but we see data from all of these organizations around the world and we have now identified more than 40, 80% of them in the united states where the attacker then unleashed a second wave, if you will, and then penetrated these organizations and inflicted further harm. so it is a wake-up call, it is a moment of reckoning and we should treat it that way. >> if you see this as a modern day pearl harbor, i don't need to tell you after pearl harbor, fdr gave a speech in which he ta

brad smith joins me now. welcome to the "newshour," mr. smith, great to have you here. you said that this attack should trigger a reckoning, by whom and about what? >> i think it's a reckonin reckr all of us. certainly a reckoning not just those in a tech sector that have a critical role to play but for federal government as well. what we're seeing is an attack that disrupted the entire technology supply chain by planting malware into network management software from another company that found its way on to the computers of probably 18,000 enterprises around the world. unlocked the door then we've seen what is probably in a tell generals agency go through that door and then further exploit the systems, extract information from we've already identified more than 40 customers including multiple parts of the united states governmt. so it put at risk our economy then put at risk an in jeopardy our national security, it shows us that we need to do more really work together differently to better protect the nation's defense. >> i know your firm is doing a good deal of detecti

mr. smith: thank you. i appreciate the time. mr. speaker, much of the debate we have heard today has been about criminal justice and child safety implications of this bill. i'd like to focus on the trubbling aspect of this bill in the tax title. this bill would create a new federal tax on marijuana starting at 5% in the first year and escalating to 8% after five years. we always hear about tax parity in this chamber, and yet the treatment of these products compared to tobacco are vastly different. . let me say again this bill taxes marijuana which has the otential to impact society really in unknown ways or at least in ways we should all be concerned about. than half the rate of a tax -- half the tax rate of a pack of cigarettes. once these taxes are created, rather than treating them as eneral revenue where they will actually -- could actually help defray the cost with the treasury's to tax would divert tax revenue into four brand new government to make including one it -- to create subsidies for actually., this bill creates new cr

how do you see smith addressing that? mr. katyal: i think what smith does is, at least in the contracting context, give the government wide latitude. you wouldn't even need it because i think we would win even in the sovereign context, but i think the fact -- what you'd be asking is, is this really a similar circumstance at the pool stage or at the child matching stage. and there are really different interests -- that's what the government is saying -- and different harms. an across-the-board flat refusal of a government agency to say, hey, the doors are closed to you entirely is very different from the sort of individualized best interests of the child determination that they are focusing on. and, you know, they focus on disability as well, but that absolutely misstates the record because it's state law that requires foster care agencies to have a special license for disability needs. that's all that's about. again, that's not discrimination. that's specialization to meet a child's needs. justice sotomayor: has any parent be
