first, as you know any number required in puerto rico or oregon. the reason that is important is it's always seemed a kind of compromise here because of the 14th amendment applying to the states our court, this court, the supreme court was insisting upon the constitutional procedures but they didn't want to let everyone out of prison so they compromised. is that so i would like to know the total impact do you know anything about puerto rico and oregon i don't have the numbers they both filed briefs. this would have a significant impact in their states and ordered insights the two cases that are currently challenging the agreements and we also have concerns about that and the issue in the state has been raised to challenge the plea agreement as well so it doesn't just affect those that were not unanimous. it's also been raised as a claim to undermine and those are even larger in number, but just in our state we take the promise and issue those numbers at face value and i think 1600 is a lot of new trials. >> and also, it totally separate question, w

why is that so important in the case of puerto rico? puerto rico has a participation rate of 70% in medicare advantage. that will tell you how important it is for us. this will be specifically beneficial where medicare recipients will make the step of signing up for medicare part b, rather than be automatically enrolled upon turning 65. unlike anywhere else in the nation. this is something that we've been fighting for many years. -- for for many years. the lack of notice of this difference has resulted in a substantially higher percentage of medicare part b enrollees in puerto rico, pending lifetime late enrollment penalties of 10% of the premium for every year they failed to enroll. currently, almost 40,000 medicare beneficiaries who live in puerto rico are paying lifetime penalties of 20.3 -- $20.3 million a year. these account that 43.5% of my constituents live in poverty and they are not eligible for s.s.i. or medicare subsidies. i introduced h.r. 2310 to address this disparity and encourage my colleagues to also support this legisl
