i am betty parker, the mayor of the city of elizabeth city. i am accompanied by my city manager, mr. freeman, by my chief of police, chief eddie buffalo, and we are here to make a few statements in reference to the shooting that took place in our city this past wednesday, april 21st, 2021. let me, again, express sincere con do condolences to the family of andrew brown, sincere condolences from elizabeth city. as a mayor of elizabeth city in which your loved one was shot and killed, for the past few days i have been concerned about giving your family and friends adequate space and time to grieve. we can only imagine the pain that you must be experiencing, but we are sensitive to your concerns. there are two separate law enforcement agencies in our community. some of you may not know this. t elizabeth city police department, and the sheriff department, which is county. none of the officers of the elizabeth city police department were involved in the process of issuing the warrant to mr. brown, nor part of the subsequent events that transpired. t

joining us now, the city manager elizabeth city, montre freeman. mr. freeman, thank you so much for being with us. the curfew is mao in effect in elizabeth city. can you explain why you felt the need for that measure tonight, and what authorities are prepared to do if demonstrators do not go home in short order? >> yes. so really quick, i do have a twin brother. that's monte. i'm montre. the curfew went into effect because of some of the results we saw happen last night. the protests ended last night around 9:00. at least that's what we were told. and then there was a second group that went out after that. that group began to do some things, throwing rocks, egged some police car, things of that nature. and so that's a big piece of how we did that. the other piece of executing a curfew is to try to clear the skreets a little sooner because we're having a lot more cars in the city now. a lot more people are here so, a lot more traffic. and we want the try to protect protesters. my initial initiative is till my initiative is to protect the protesters as w

brian todd in elizabeth city, north carolina. appreciate your reporting. >>> joining us is marq claxon. according to the family, they believe andrew brown jr. was in his vehicle and attempted to drive away from the officers. what is the protocol for when that happens? >> well, there are clear rules and regulations as it pertains to fleeing felons, if you will. but the real variations of it is whether or not there's an actual case that mr. brown was a felon, whether mr. brown was actually the target, a subject of these warrants that we've heard about, whether or not mr. brown had prior contact, prior to the 22nd c -- 20 second clip that the attorneys had an opportunity to view and analyze. so many questions and what's potentially dangerous in this case is the response of the north carolina officials from the sheriff's office to the county attorney. there seems to be and the concern is whether or not there is a cover-up of some level going on there in elizabeth city. >> and to that point, areva, the family and the community doesn't

look, the people who are out here right now in elizabeth city are in the heart of elizabeth city, north carolina. we have shut down and interstate here. or the inner workings of the city here, it's a street and intersection. the reason why they say they're here is not just to say the name of andrew brown, jr., but they want answers and they want the sheriff to give answers directly. the sheriff has been speaking on these press conferences and not speaking to the community. as you can see, i've got quinton jackson here with me. not only did you know andrew brown, but you're out here demanding information and they tell you more. >> that's right. we want them to come out. the sheriff was elected by the people, so he needs to come out here and answer these questions. when you look around, you see deputies from all over. but yet, the sheriff is not out here. he said we're getting death threats, that hasn't come from anybody out here. everybody out here has been very peaceful and respectful. of course, we have community leaders out here just in case any outsiders come from out of time and not

that includes the elizabeth city council. the city has issued a formal letter to the sheriff's office to wait for their response on that. a coalition of news organizations have now filed a petition with the state court. that includes cnn. so, this is going to be quite a process for the public to see this. but it is quite a step for the family now to have privately seen the footage that no one has seen for more than five days since andrew brown jr. was shot and killed by deputies as they were executing a warrant related to felony drug charges, according to the sheriff's office. we, of course, today cnn has obtained the death certificate for andrew brown jr., showing that he died with a penetrating wound to the head and the death was categorized as a homicide. so, this information, very troubling to the family members, to the community that's been walking and marching peacefully throughout the city for the last few days. really just asking questions and not getting many answers. city officials even saying, the city mayor today

he's live in elizabeth city, north carolina. brian, pardon me me for my error. thank you for joining us this evening. we're still waiting for the body camera footage by cnn. we've obtained this exclusive video from the aftermath of this shooting. what does it show? >> reporter: well, don, this is video we obtained from a neighbor who lives across the street from andrew brown's house. this neighbor filmed what is essentially the immediate aftermath of the shooting. you do not see the actual shooting in this video. what you do see is andrew brown's car crashed on a tree across a grassy area and across roanoke avenue from where his house is. he tried to get away as his lawyers have acknowledged. they say he was trying to evade the sheriff's deputies who were there, that he made concerted efforts to evade them so that he wouldn't harm them. he did crash his car against a tree on that other side of the street. there's a white house that you see in that frame there just to the right of where his car is. that house got a bullet hole in it from the firing. we talked to

this time we're talking about elizabeth city, north carolina. the fatal shooting of andrew brown jr. there is so much still not known about what happened here. but neighbors who witnessed the encounter with police described it as chaotic. one thing we have not seen yesterday is body camera video. joining me is brian todd in elizabeth city. he's been talking to a lot of people there. brian, why are they saying they can't release the body camera video? what are you hearing there? >> what the local d.a. is saying is they can't release it because under north carolina law they're not allowed to release it unless there say court order to do so. several entities in town are petitioning for that court order. so there is significant pressure on the da's and on the share you have here to release that body camera footage. look, it's a question of transparency. the brown family wants. that the local community wants that. they're demanding some answers here. they feel that they're not getting the answers. they believe that a lot of the answers are going to c

and friday elizabeth city council held an emergency meeting requesting the videos be publicly released and today city officials declared that request formally will be filed monday. cnn's natasha chen is in north carolina for us. you were at the briefing last hour that involved the mayor, city manager. it sounds like they too feel like they're in the dark about what happened. >> yes, fred, they said they have not seen the body camera footage, they have not seen any evidence from the case. in fact, the elizabeth city police chief said typically they work hand in hand with the county's sheriff's department regarding search warrants like this and in this case in particular, he nor his command staff were privy to the details of any warrants that were executed on wednesday. so, again, they are making a clear distinction between city officials, city operations and the county operations that resulted in the shooting death of andrew brown jr. the mayor herself stated that, you know, this was really important to serve their citizens here and make sure that even though they were not party to this

cnn's joe johns is following the latest from elizabeth city. so joe, walk us through what we see, what this new video shows. >> jim, we got that video from a source. the source says it shows sheriff's deputies arriving to serve that warrant on andrew brown last week. they are in a pickup truck. there are commands that you can hear on the audio. it's not clear everything that is said, but we know the result at the end of the day even though we can't hear the shots being fired. the result is that andrew brown ended up dead in his car. now that is not the video that is the source of a hearing today in elizabeth city. that hearing is about the release of the body camera video from the sheriff's deputies who were on the scene. as you know, the law provides here in north carolina that officers and sheriff's deputies may have privacy rights in such videos. and so the question is, who will object if anyone, to the release of this video, to the community and to the family. the other headline here from elizabeth city is that the charlotte officer of the

cnn's natasha chen is live in elizabeth city. natasha, the sheriff has explained why his community cannot see the body camera video right now. what's the reason? >> reporter: yeah, so, pamela, this has a lot to do with north carolina requiring a court order for such video to be released, according to the sheriff. you can tell the family is very disappointed when they met with the sheriff yesterday, they were expecting to perhaps see this footage and they were disappointed to find that they could not do that. elizabeth city officials have held a press conference this morning, saying they have very little details about what happened and they have also not seen any evidence nor have they seen the body camera footage and the sheriff has maintained throughout the last few days that he wants what the citizens want, but it's going to take some legal process to have this happen. here's a video he posted to facebook this afternoon explaining exactly the steps he's going to take. >> because we want transparency, we want the body camera foo

they call him drew brown here in elizabeth city. can you see behind me some hundred or so protesters have turned out, started marching about 30 minutes ago and what they want, wreath, is they want the body cam video of the it county sheriff to be released in the shooting death andrew brown jr. this started yesterday when a search warrant by the sheriff's deputies was issued and brown fled the house in his car. deputies shot him, killing him, and that is the video they want to see. now the sheriff's office says that the matter is under investigation by the north carolina state bureau of investigation. but ultimately the fbi says the decision to release such video would be up to the sheriff's office pursuant to a court order. and so what you are looking at now, bret, are protesters marching through elizabeth city, this is the main street airing house street because right through downtown and they are blocking traffic, it's been very peaceful. you can see police have sort of anticipated their move and trying to facilitate things as bes
