david jolly, former republican congressman and msnbc political analyst, and joyce vance, who's hopefully, her crystal ball is working once again, former u.s. attorney and an msnbc legal analyst. donna edwards, let me start with you on this one and talk about those nine republican congressmen. i wonder if steve bannon here was an easy target, right, to vote and hold him in contempt. but whether or not they would actually make the same decision if it came to others like a jeffrey clark or a mark meadows, folks that were seen as they colleagues. >> you know, i was reminded that in october of 2015, hillary clinton had been subpoenaed to appear before the benghazi commission. she was a private citizen at the time. she was no longer in government. and she complied with that subpoena, testifying 11 hours before the benghazi committee. there is -- steve bannon may be an easy target, but here's the thing. congress has a right to issue subpoenas and they have a right to expect the american people do that those subpoenas are going to be enforced, and so i think it was really important for the congr

david jolly froze on us. a.b., do you know? >> it's obvious that josh holly is courting a constituency for the passing of donald trump off of the political stage at some point and the young holly is hoping for a big political future as a presidential candidate so he has, you know, fist bumped to the inth direction and on and on. the problem is these republicans who are remaining silent or trying to pick a fight with the government that's looking into threats against people's lives and stalking and harassment and real endangerment are actually complicit that we have a growing threat of violence. look how far away the next election is. we have school officials and school nurses with threats to their lives and people harassing them and stalking them and running them out of these jobs on purpose. this is not a spirited debate. at a school board meeting. this is not a peaceful protest. these are real threats. it's outrageous and it's dangerous and we're talking about real potential for violence that they know is coming. and in their

david jolly is here. how do you get rid of kevin mccarthy? >> well, look, that's a really good question, nicole, and we'd like to do our best to make it happen but there's something that i'm going to say up front here. realistically, there are some members on this list that are in super safe districts that they're going to be very hard to defeat, but in the case of kevin mccarthy and steve scalise, the reason why we put them on this list is because what we think needs to happen is we need to deny them a republican majority. it's pretty unlikely we get mccarthy and scalise of the folks on that list out of congress, but at a minimum, we need to keep them out of the house majority. now, what i'll say is that when we look at what republican leaders in congress are doing to police their own ranks, we see them completely missing in action. so, kevin mccarthy and steve scalise have done a very poor job of policing madison caw thorn and marjorie taylor greene and these extremist members of congress and so what we're doing, a group of former republica

david jolly said, this seems to be the strategy. i thought the way to win elections was to have better candidates and better ideas. this seems to be the way to keep elections is to keep people you don't like from voting. >> you just -- not that i needed it, but you just made the filibuster sound even more obstructive and heinous than i already think it is. why are democrats not united in filibuster reform to preserve the right to vote, to preserve the right to have votes counted? this is the republican strategy, and i don't believe that you're actually surprised that republicans don't want anything to do with voting rights legislation. are you? >> i'm not surprised, no. i'm not surprised because there really hasn't been any outreach. the compromise bill that we worked out over the summer has been around for more than a month. nobody's come forward with a counterproposal, or, hey, we could maybe do this. the reservation, nicole, is that this is a double-edged sword. right now, the filibuster is being used to obstruct. it could be use

maya rocky more cummings and congressman from florida and msnbc political analyst david jolly. david, i'll start with you voters will head to the poll on tuesday across the country. there are two governor races we're watching very closely. in virginia, it looks like a virtual tie between democrat terry mcauliffe and republican glenn youngkin. with youngkin up less than 1% according to the real clear politics polling average. in new jersey, incumbent phil murphy is holding on on to nine percentage points over his republican challenger. but let's remember, this is a state joe biden won by nearly 16 points in 2020. what are you expecting to see on tuesday night? >> it appears phil murphy is very safe and we're coming out of the dynamics of the covid environment, phil murphy was one of those governs that took a strong leadership role. so i think voters -- it is telling that voters are going to likely reward him with another term. virginia's different. virginia is a big deal. we'll see what it turns out. largely it will be a momentum play for either party. how far it turns out, that

. >> now to my political panel, joining me now, two former members of congress, david jolly, republican from florida, who has since left the party. and donna edwards, democrat from maryland. both of my guests are msnbc political analysts. now, with two former members of congress on the panel, let's start with your former workplace. the two infrastructure bills are subject of a lot of scrutiny. but not around their actual content, which includes dozens of overwhelmingly popular proposals. they say there are two things you dont want to see made, sausages and laws. the process is messy. but david, aside from republicans' total refusal to engage in governing, is this messier than usual or just democracy in action? >> well, part of it is the latter, democracy in action, but what's made it messier is democrats have really decided to double down and gamble a little bit here to try to swing for the fences instead of take the double. what i mean by that, reverend al, is joe biden and democrats have largely already accomplished something that donald trump couldn't do for four years. the $1 trilli

joining us now is david jolly. let's talk about this agenda because you're watching, we're really watching the sausage being made, but it's a rare time when the leader of the party says i'm going to a summit, i'm going overseas, i need this. we could lose midterms, you could lose virginia, and they are saying it is just not good enough. >> yeah, this was not so much by joe biden to the nation, but to really house progressives. this is a resignation that every time they reopen, the number goes lower and things come out. i think they're saying that we have the best question get. i need you in this moment, and look this is a test of joe biden's leadership in the last few minutes. barack obama is out with a statement saying this bill has a lot of wins in it and the fight continues. house progressives have hard decisions to make now. if progressives are correct to point the fingers an manchin and cinema, but the numbers are not there. this is a real telling moment for house progressives. perhaps they just stand and say

jolly, msnbc political contributor. hello. glad to have you back on this sunday, as always. don, why break up these houston districts that are so symbolic when it comes to representation of black texans in congress? >> to dilute minority representation, to dilute student representation. representation from groups that are more likely to vote democratic. this is absolutely a partisan effort to break up districts that would be likely to vote democratic, thus making them more competitive, especially in suburban areas for the republican vote. not only that, you're taking out at least one of two really dynamic, really vocal, really experienced good legislators in sheila jackson lee and al green, both of whom have substantial power. you're eliminating substantial power for those districts in the state of texas, but it's a partisan play to continue to tip texas more in favor of republicans. >> i hate having the both of them pitted against each other because they're both outstanding and so devoted and so experienced. susan, you

joe crowley, thanks david jolly. >>> we have breaking news from the supreme court on that controversial abortion law. nbc news' correspondent pete williams with details. >> they've taken challenges on sb 8 that banned abortion on six weeks of pregnancy. the courtological hear a straight-up challenge to the constitutionality of this law. that's the lawsuit that was provided by abortion providers in texas. that's the case that the supreme court declined in early september, to act on, to put it on hold. so the supreme court is now saying it will hear that case november 1st. so it's acting with amazing speed here. it's going to hear a constitutional challenge to texas' sb8 on november 1. and on the same day, the supreme court will also hear that the federal government has brought against sb8. and the question in that case is not so much the constitutionality of the law, but the question of whether the federal government even has the legal right to sue texas over the law. the question that it's limited to is this one. may the u.s. bring suit in federal government and obtain injunctive or rel
