jennifer, do you see any chance of success there? >> i don't see anything obvious. they can appeal based on legal errors made by the judge, issues with jury selection. there are all sorts of things they can appeal. they can even appeal saying that the evidence was insufficient to convict. so nothing jumps out at me. i thought the judge was good here. he made his rulings properly, at least as far as i saw. i didn't see any big issues with the jury. the sufficiency of the evidence, sure, there was plenty of evidence in the way the jury assigned relative culpability with their verdicts demonstrates they carefully viewed the evidence. i don't see anything here. we'll have to see what their papers say, but it seems like an uphill battle to me. >> no matter what happens with these state charges, they still face federal hate crime charges for a trial that's due to take place in february. and those charges in the federal case also could carry a potential sentence of life in prison. elliot, what do you expect in that federal case? >> there's a lot of, you talked about race e

joining me for more is elie hoenig and jennifer rogers. first, elie, can you take us inside the jury room? what happens now? >> yeah, kate, this is one of the great mysteries of our legal system. the jurors have been instructed as to the law but they're not told to do when they get in there. typically they first elect a foreperson, but then they approach it in different ways. all we are going to know is we'll get little hints periodically over the next several days. they will send out notes, ask to see certain evidence, have testimony read back to them, and we will try to figure out if that looks good or bad for one side of the other, and eventually they will hopefully send out a note that says we have a verdict and we'll take the verdict. they'll vote on each of these counts individually. it's not all guilty or all not guilty. we could have guilty on some counts, not guilty on others. >> let's jump into this, guys, because from jury instructions to closing arguments, it was a marathon day yesterday for the jury and what they were expected

jennifer, because of the history of democrats, you know, the last 10, 12, 15 years, because joe biden won by ten points, this is not what democrats are expecting. this is making them very nervous. what's going on? >> it is. i think a couple of things are happening. joe biden has had unified congressional control in washington now for about nine months and democrats don't see a lot of progress. what we just saw from joe manchin is a perfect reason why. but what that means is that voters who were expecting to put democrats in power so they could really push forward an agenda are walking away a little bit depressed by that. that makes it difficult to motivate them to turn out to elect another democrat. the other point i would make is democrats are still on board for terry mcauliffe. republicans are on board for glenn youngkin. this comes down to the independents. what we're seeing is independents moving toward youngkin in the last couple of days, again, because they don't have a lot of faith in what the democrats in washington have done, why should they have faith in mcauliffe in richmon
