rudy giuliani, jenna ellis, and sidney powell and former trump campaign adviser boris epshteyn. they obtained records of phone records of eric trump and kimberly guilfoyle, engaged to donald trump jr. anchor of "inside politics" sunday, abby phillip, and national reporter at "axios", jonathan swan. great to have both of you on board this morning. jonathan, i want to start with you. you have reported extensively on this period of time. in fact, the letter to sidney powell that subpoenaed her to talk to the committee includes some of the reporting that you have done. and you say that you absolutely cannot do a serious investigation without focusing on these three people. who are your takeaways from the committee? >> reporter: well, it turns out now both sidney powell and rudy giuliani subpoenas my reporting on trump's final days. it is important for people to remember the context. by mid-december of 2020, these fringe lawyers, rudy giuliani, jenna ellis, sidney powell, had supplanted the professional lawyers in the white house and at the republican national committee. and they tol

rudy giuliani, jenna ellis, boris epstein, and sidney powell, who, of course, fronted donald trump's a-team, legal team in the fight to overturn the election results in several key swing states by falsely claiming widespread voter fraud all over the country. of course, as we've been discussing, there was none. committee chairman bennie thompson writes in a letter released just a few minutes ago, this, quote, the select committee is looking into the causes that contributed to the violence on january 6th, including attempts to promote unsupported claims of election fraud and pressure campaigns to overturn the 2020 election results. the four individuals we have subpoenaed today advanced unsupported theories about election fraud, pushed efforts to overturn the election results, or were in direct contact with the former president about attempts to stop the counting of electoral votes. we expect these individuals to join the nearly 400 witnesses who have spoken with the select committee as the committee works to get answers for the american people about the violent attack on our democracy.

rudy giuliani, jenna ellis, sidney powell. how complicated does it get when they're trying to speak to donald trump's lawyers in a matter such as this? >> as complicated as it can possibly be. you have the normal issues of executive privilege, which is in the court right now, as carol pointed out, related to the archives but also mark meadows and others have claimed executive privilege. but you add on a layer of attorney/client privilege, it gets legally complicated. the congress does not recognize, technically, attorney/client privilege, because that's for the courts and not in the constitution. but it hasn't been litigated. there are many exceptions to the attorney/client privilege including the crime fraud exemption, meaning if they're in furtherance of a crime or fraud, they're not covered by the privilege. there needs to be a neutral arbiter who will decide whether or not the privilege applies, assuming that there is a privilege. and that's a mechanism that requires congress to go to the court. i will add, though, that to
