bret? >> bret: mark, speaking of trump and law enforcement, today a federal appeals court ruled the justice department needs to release a memo dating back to 2019 about the mueller probe. what can you tell us about that? >> bret, well, this is a memo that was basically outlining some of the internal deliberations that was happening at the justice department back in the bill barr era about whether or not the then president trump could possibly be charged with obstruction of justice as a result of the mueller probe. the justice department had been arguing that these documents were private deliberations, the judge disagreeing says the memo should come out. of course, trump was never charged as a result of the mueller probe while he was in office. bret? >> bret: mark meredith just outside of mar-a-lago in palm beach. mark, thanks. lindsey graham must appear before a special grand jury in atlanta. that grand jury is investigating whether then president trump and others illegally tried to influen

bret baier back on set with us now here in new york. bret, you heard the conversation i had with the former attorney general, michael mukasey. the two most important words here were "not possible." merrick garland said that in every situation, they try to go in in the least intrusive way possible, but that in this situation that was not possible. >> bret: i was struck by that. i was struck by that he personally authorized the decision to search the former president's home and he did not take it lightly. he said that as part of this filing, the justice department invites the former president to object. he's filing for the release to make public the search warrant and the list of items taken and trump and his attorney could object to that motion, which is fascinating. basically what he said in the five minutes is we had to do it this way because it was just not possible. could be argued there on a number of fronts. then he said because the former president said what he said when it was happening, we then had to file for this to be open. o

bret, you have something. >> bret: just follow-up on that. >> sandra: sure, go. >> bret: yesterday i mentioned a -- the presidential, president obama's records in passing i was talking about the declassification, the power that the presidents have to declassify but there is a process. president obama, according to nara and the statement and everything yes know followed all of the processes to get those documents to chicago. there was a lot of grumbling they had not been posted online as promised, but how they were handled was done by that process. so, the difference is, and i was in a list of things i was talking about that and plus sandy berger and what happened with him stuffing documents down his pants and his socks and the hillary clinton email stuff in a string of things. the president obama documents were handled properly and the question is, whether there's a paper trail and a process for these documents if that's what the trump lawyers and the former president are arguing. >> mike: bret, as we have traveled the world and presidents are given things by foreign leaders and pict

with that, we go back to bret baier. bret, good to have you back with us. the latest information that you're hearing on this. >> hi, martha. we reviewed the search warrant and the list. what we haven't seen is the affidavit that supports this. that's really what would lay out the case that the magistrate's signed off on. the information that they were looking for that they specifically listed. in the search warrant, it does have u.s. code and what exactly they're saying he's under investigation for. that is technically potential obstruction of justice and violations of the espionage act. this is tssci, the highest level of classification short of special access, which is the nuclear materials specifically. tssci. there was one box in the set of 11 with classified materials that is found with various classifications and tssci documents. they don't list exactly what is in there. now, we've been talking about you talked to kash patel and the declassification process. i listened closely. it's fascinating, this is unprecedented. usually when a president goes thr

bret, you first, anticipation building for this moment. >> bret: it is a big moment for the attorney general to answer some questions we have not heard answered. the subpoena was confirmed for sensitive documents taken from the white house, delivered in the spring. the trump officials and president trump say they were complying with that, they were dealing with that, were answering the questions. obviously something happened and the doj officials, fbi officials did not believe that was happening and that precipitated what then led to this search, this raid of mar-a-lago. a lot of things we don't know about cause of the search warrant, about the extent of the decision to go with this public of a show of this search to a former president's residence. and it's obviously in this environment, months away from the midterms. >> mike: 72 hours have gone by since the high profile raid of the former president's residence in palm beach, florida and no public comments so far. undoubtedly the pressure is building as they are tired of fielding questions why the raid, why now, and now we are waitin

bret: i agree with you. what the trump camp is projecting clearly. it's more and more the case that this doesn't seem to add up. we don't know what we don't know. the affidavit will be helpful to the layout. but you look at the search warrant, it's super broad. you can go into any place in mar-a-lago that the former president may have been working, may $have been staying, may have had access to, and you can get any doubt that deals with his type as president. from the type he gets in office to the type he leaves office. now, the trump people say that the former president declassified the documents that he took. then they are saying he doesn't know exactly what was in those documents because the general service administration packed up the boxes and he didn't actually know what was in them. at the time, january 6, january 20, there were some things happening at the white house and washington. i think it will be fascinating to see how the doj deals with this. to get to this level to do that kind of raid you have to have some serious juice there. if it'

the read from bret baier. bret, what do you make of it all? you've been taking it in. >> yeah, it's been amazing to watch. listen, what we learned today is the specifics of what they're looking for. the possible violations as you just heard from tom as three federal statutes. the espionage act, the law prohibiting the destruction of documents. just to show you how serious, the subsection of the espionage act that is most -- the criminalized part says this. obtaining information respecting the national defense by someone with the intent or reason to believe that the information is to be used to the injury of the united states or to the advantage of any foreign nation. so you know, you're getting to really serious possibilities here. but what we don't know is the -- how you get there and this timeline that you just talked about doesn't add up. there was cooperation. there was a subpoena. then there's not. there's a lack of follow up and then there's a search warrant august 5 and then they wait a number of days before they do this search or raid

. >> bret: look at the past of classified documents. you had president obama that took a ton of documents and said he was going to put them online. they're not online yet. you can't search them yesterday. nobody was breaking down a door. was it national securityish you'res at that level? we don't know. there's other examples. there's hillary clinton, sandy berger in the clinton years. how it was handled and the disparity is what conservatives point to. that really ticks them off. they want to know why. on the flip side, the former presidents attorneys need to answer, are they and why haven't they put out the search warrant that they received and the list of documents. >> neil: to your point, the presidential records act was enacted in 1978 in the aftermath of the water gate scandal. there's never been a case in which a former commander-in-chief has been punished for violating the presidential records act. thanks. >> martha: thanks, charles. >> charles: back with us now, former u.s. assistant attorney, andy mccarthy and general john yu.

bret, we've been showing images throughout the day. you've seen the former president's supporters showing up outside trump to youner new york city, showing up honking their horns outside of mar-a-largo. seems to be rallying his base. there's going to be a lot of political fallout that we'll see as a result. >> there will be. i said at 2:00, even shoring up people that are skeptical of former president trump as his communications style or as being a politician, but liked his policies. they look at this as overreach and concerned about what it means for the federal government going forward on a number of fronts. what happens is, it's an easy story to tell for trump supporters in that you come after the russia investigation, and all that happened and all that we heard on channel after channel of that never really was resolved. they never came out and said we're sorry. we got this wrong. and then it went away. but he was under attack for a long, long time. what we don't know is exactly what the doj is looking for. that is the opening here.

bret? >> yeah, listen, we knew that the president had waived the previous president's executive privilege and it was bizarre when it came out publicly when he did that. but it was public at the time. then it was confirmed in that nara letter that we saw this week about that. and that's what generated this move forward to get these documents. so the white house overall, 30,000 feet, knew something was happening. the president insists he didn't know the timing and exactly when that raid was going to happen at mar-a-largo. i think that there's more to ask about the white house knowledge of all of this. but i will say, martha, there's a couple other things as i'm reading through this 38 pages that are interesting, one is -- this will not sit well with the former president. in the legal memo, justifying the warrants, is this line that reveals that the fbi and the justice department spoke to a "significant number of civilian witnesses" about the former president's actions. significant number. tha
