that's judge aileen cannon. trump announced his intent to nominate cannon. she was confirmed in the senate that here. after trump lost the election in trying to contested and overthrow american democracy. federal judges around leases assigned to cases but trump has tried to get more before a judge cannon previously. in fact, earlier this year when he sued hillary clinton and former fbi officials over the russia investigation, subsequently thrown out, he filed a suit in south florida where mar-a-lago is. but as the daily beast reports, when his attorneys filed the paperwork they picked a tiny courthouse in the furthers fire east corner, 70 miles from mar-a-lago. they ignored the west palm beach courthouse that is a 12 minute drive away. now, the scheme failed. trump's case was assigned to a clinton era judge who called him out for forum shopping. noting, i know the plaintive filed this lawsuit in the fort pierce division in this district where only federal judge, sits judge aileen cannon, who plaintive appointed in 2020. of course we should be clear, there ar

>> the justice department filed its formal appeal of this ruling from aileen cannon, the judge down in palm beach who had given donald trump a chance to have a special master to review these 21,000 pages that were seized as part of the fbi's search in mar-a-lago back in august. the justice department is saying that the judge had abused her discretion, they're quoting and say exactly from a previous ruling from the court of appeals in atlanta, and pointing out that not only does donald trump have no reason to have a special master appointed, he's not even asserted a claim of personal attorney-client privilege. i'm read you a part of this court filing. it says the plaintiff has not asserted a claim of personal attorney-client privilege that would justify the district court's order. he has no plausible claim of such a privilege with respect to records that are bearing classification markings or any other government documents related to his official duties. they're pointing out that the judge in this case, aileen cannon, overstepped her jurisdiction here by appointing a special master. now

one sentence gone. >> what it says, and i think very much to ken's point and yours, is the aileen cannons, they're the aberration, they're still outside of the mainstream of judicial prudence that you -- that you hope and expect from your judges, in other words, they're going to look at the arguments that are presented to them. they're going to weigh those against the facts and the law, as they say, and they're going to rule accordingly. the 11th circuit, not the 9th. it's a conservative circuit. a lot of folks initially were like, oh my god, this is going to be trump's lawyer handing him what he wants, and what they did is they stood up the constitution. they stood up the rule of u la. -- rule of law. they applied the law to the facts to the arguments being made, and to ken's point, they came back with one sentence, that basically said, hell no, go back home, this isn't going to work, and that's good. that's refreshing. i don't know how much more restrained the judicial system is going to withstand in the coming months and years, and at least right now, they're holding to the constitutio

the august 8th court-approved search has been slowed by some of trump's successes in front of judge aileen cannon? >> oh, i think that's -- you know, look, merrick garland and the team around him is -- are extremely cautious about commenting on any of this stuff, especially given the fact that, you know, if republicans take back the house these guys are going to be really on the defensive. but they are very clearly frustrated with the delaying tactics. and frankly, you can read -- there is a level of contempt in some of these filings that even a legal layperson can clearly see. there's also -- i mean, you read these things, i mean, their first response to judge cannon was borderline contemptuous. i don't think you can really characterize it in any other way. and i think what's interesting about all of this is just how quickly they want to move on this. and for the viewers out there, that doesn't necessarily mean they want to move quickly so they can bring a case. it's just as likely that they want to move quickly so they can rule out prosecutions in some instances. but there is a general s

( applause ) with crispy skin? the justice department warned cannon that they would appeal her ridiculous ruling, unless she modified it in some way. she said she wouldn't, so they appealed it. and last night, the 11th circuit court of appeals ruled that the justice department can use the mar-a-lago documents in its criminal probe. department is how sweeping their criticism of the district court in this case, remember it was judge aileen cannon in florida who initially stepped in, appointed a special master, restricted the documents the doj could use, a lot of that was overturned at the 11th circuit but doj goes right for it criticizing the district court for those actions they had taken that the judge had taken several weeks ago. then they talked about the fact that the jurisdiction that the 11th circuit had was okay because remember, trump's team is going to the supreme court on a very nair rerrow limited basi here. they're saying the 11th circuit did not have the power to restrict those 100 classified documents from the special master, and from trump's own lawyers. that was the very limited jurisdiction -- the very narrow way they went to the supreme court, saying the 11th circuit never had jurisdiction over that. the justice department here saying, yes, the 11th circuit did have the foupower to act he and they focused on the fact that there has been no harm to donald trump. the supreme court should not step in, be

judge aileen cannon has done a series of rulings that favor him. i think that's a really corrosive and sort of dangerous view that we have trump judges, obama judges, it really, i think, you know, subverts people's view of the judiciary as independent. >> and certainly they had stood firm in recent years. lastly, give us your quick analysis on the dilemma of the department of justice where a decision will be made over whether or not to indict former rump, staring at this mountain of evidence, and many believe it's hard to come to any other conclusion. what's your take? >> they're going to be under enormous pressure. no decision has been made. they are investigating the hell out of this. it's going to be merrick garland's decision in the end. whatever he does, he'll be criticized. liberals expect an indictment. the strongest case and the much stronger investigation is the mar-a-lago case, the classified documents. i have heard the january 6th case, the sort of clear legal theory of prosecution isn't there. these stories of trump, you know, ordering

they have to go to the appeals court for this is of course because of trump appointed federal judge, aileen cannon who has repeatedly ruled in trump's favor as he has sought to block the government from getting access to its own documents that it seized from trump's florida home. the way the doj got access to the approximately 100 classified documents from mar-a-lago was by getting the 11th circuit to overrule judge cannon on that one point. but it wasn't clear until tonight that the justice department was going to continue fighting in earnest for the unclassified documents as well. clearly they are here tonight asking the appeals court to expedite this whole thing so that it can be adjudicated in the next few weeks. joining us now is john fishwick, who served as the u.s. attorney for the western district of virginia during the obama administration. john, thanks as always for joining me tonight. >> thanks, for having me on your show. >> let's talk about this filing here. the fact that the doj thinks the records mishit light on how the materials bearing classification marks were transferred
